As long as the credit report that you have is very recent it should be enough to establish last activity. Ideally have both from TransUnion and Equifax. They will collaberate each other.

It is not like you are working with a week or 2 descrepancy...its 6 years.

If they call you tell them to take you to court and hang up.

How can i make it absolutely certain that last activity was more than 2 years ago. I only have proof of my credit report

Is that enough to satisfy the court in case there is a hearing.

or shall i send a letter back to them saying that this debt is outside the statute of limitation.

If you are absolutely certain that the last activity was in 2006....then do nothing.
Yes they can still sue and hope you do not show up in court and obtain a default judgement, but other then that....they would have no way to force you to pay anything.

In the unlikely event they do serve you with a Statement of claim you can use the SOL as an Absolute defence. Hence the case would be dismissed .
Then all they could do is continue to hound you until they realize its a lost cause and a waste of their telephone time that they can be using intimidating someone else.

Contact Resource Service/Statute of limitation ontario.

Postby voyager » Thu Jan 19, 2012 09:59:39 PM

I got a letter from Contact Resource Service. for a credit card debt for 4200

They want me to dispute it within 30 days. I have been reading in the forum about the ontario statute of limitation that if the creditors don't take you to court in 2 years times, the debt become stats barred or time barred.

After reviewing my credit file, the debt seems to have a last date of activity from 04-2006.

As the debt is about to be purged from my credit report anyways in few months. Shall i contact them and have them validate the debt or ignore them. Can they still sue me? I am sort of confused i feel like ignoring them as they can't enforce anything in court.
