Just an update if you are interested in whats following:
from the loaner:
"Unfortunately we haven't heard back from you, and as all the paperwork is ready for court I thought I'd make a final plea to you. ********, we've known each other for a long time and in light of that I thought I'd let you know candidly what will happen. The plaint is ready and as soon as I sign it and the affidavit, the case is filed. There will be nothing more we can do; even if you pay before the hearing date you'll be held accountable for the filing charges, cost of serving and our lawyers charges, not to mention the loan itself, possible interest and cost of suit. Serving you means placing an ad in one of your daily newspapers. ******* I'm sure you don't want this embarrassment as well. I'm only telling you this as a friend - this will be the legal procedure. Whether you see the notice to serve or not will be irrelevant, once the notice runs in a national newspaper, notice is considered as being served, and should you not show up for court, well...I'm sure you know the consequences!
As I said I'm saying this to help you see the ramifications of not responding, and as a friend I wouldn't want to see this issue tarnish your reputation more."
My question is where is the court being held and is this soimething to worry about?
(I am writing out of my personal guilt to pay someday. also there was no deadline on the original loan contract... makes a difference?
