I guess you have nothing to worry about. If the debt went to collections or it was sold, then his credit is probably not good at this point.

Well jokes on them we live in apartment I just want to make sure that his assets and credit stays at what it is?

Is the home in the process of being sold or transferred in someone else’s name? I believe they are more worried about getting money, then suing you.

Thank you Joe for your advice I will do that. However is it still possible for them to take my father to court under any circumstances regarding this matter? I'm just worried because I don't want a defult judgment. They have actual threatened to take our house and asets and tarnish my fathers credit. So I'm not to clear If they can still do anything that will jepordise any of that?

I know you can get them down to 10%, because of the circumstances.

Hey Joe, and everyone else thanks for your condolenses, I just got an email SETTLEMENT LETTER and they have given me a Offer of $3,967.69 due by August 28th on a $13k debt and my dad owns property .......wooohoooo, I will take that as a win............ He has like I said about $7,500 overall for his debts moneywise and now have only about 25k left of debt and will continue on with the next creditor..............I already have the SETTLEMENT letter emailed to me and I am in BC and it was sent at like 5:20am my time, so they must be in ONTARIO, now that I have the letter agreeing to that amount, I am going to try to get a lower amount and will update all of you today.....

I offered $3,300 and I knew they would counter................LOL

I wouldn't do nothing, pay them nothing and just ignore them. The statute of limitation to sue you expired over ten years ago. If you decide to talk to them; I would state to them that the statue of limitation has expired and you are now considered stats barred. I would also state to them if they keep calling you, you are going to put in a harassment complaint with the rcmp.I believe by law after so many years a debt that has passed it's statute of limitation; they are not allowed to call you anymore.

sorry for your loss as well.

they offered my father a deal of $1,445.00 to be paid in full. This happen about 17 years ago of roughly $1,800.00 loan.

now from what i was told it has been paid of in '92, but they say its been in collections this long.

now if something like that has been in collections this long how does he get really good credit. i know for a fact that he payes his dues.

now there telling me if he dosen't pay the $1,445.00 then he has to pay $8,444.30, racking just over 6k in intrest. Whats the deal with that can they even do that.

17 years and just comming to him now?

What can I do that would be the best bet as well as legal?

Sorry for your loss. I believe in your case, you don't have to offer them anything since your father has passed. If you’re settling your dad’s debts for moral reasons, I can understand that. I would write up a letter to all the creditors explaining what happened to your dad. I would offer them in a one time lump sum settlement offer of 10%, to be paid by the end of this month. I would leave out the part that you are the executer. If they decide to accept, make sure you get the agreements in writing and faxed to you before you hand over your money. I believe you know this already, since you worked in the industry for ten years. If I were you; I would submit the letters to the creditors and not to the collection agencies because you will have a better chance of getting accepted for 10% after they hear your hardship.
