Hmmm. Beats Me. I had difficulty making sense out of what was happening given the dates you included on your original post of August 19, 2008. I could only conclude it was "R9" as that's when Canadian Tire Bank (Mastercard) writes this stuff off and sends it to the collection agency colony. To wit

"...Received on August 14th I get a letter dated August 7th stating "my account with the above noted creditor has been forwarded to this department to be prepared for court and legal proceedings......."

Anyway, good luck, and as I said, "mum's the word" on all your various ailments.

So, we have contacted Canadian Tire and here's the deal...I have not R9d, I am 90 days late on my Credit Reports. Having spoken to management at the number you gave what has happened is they have outsourced this part to MJR as well. I do, indeed, right now still have $70 in available credit and am free to continue using my card. All of my payments are to be made to Canadian Tire and not MJR and I will keep receiving account statements since the account belongs to them.
Apparently what usually happens is people freak out and pay it all. This is why my offer of $800 was rejected and that's out of the mouth of Canadian Tire themselves, they want 1100 or are happy to keep taking my payments.
The catch is, however, if I miss a payment it will become full property of MJR and they'll have the history and missed payment info to pursue it further if they so choose.
Still leaves me shouting Aaaarrrrrrrrgggghhhhhhhhh!!!! but I will live with what it is, because I can't change it.

Ray,

I know MJR is the collection agency Canadian Tire sends things to, but what I am saying is that I keep getting monthly bills from Canadian Tire AND have MJR violating the Cease and Desist I had sent (They had honoured it for about 4 weeks.) Except for the fact that they don't leave a message, just run up my caller id.
On my monthly bills from Canadian Tire it states: AVAILABLE CREDIT: $39, and "YOUR ACCOUNT IS PAST DUE. PLEASE SEND YOUR PAYMENT TODAY IN ORDER TO PROTECT YOUR CREDIT RATING. THANK YOU."

P.O. Box XXXX XXXXXXX "a"
Toronto, ON
XXX XXX

So what I am wondering is What the Heck? You aren't the only one yelling Aaarrrrrrgggghhhhhhhhh!!!! Trust me. And I have received 3 bills from Canadian Tire since the first phone call from MJR, which of course came BEFORE any written notice.

Lordy, lordy, lordy..... MJR is the collection agency for Canadian Tire Mastercard. They only forwarded the account to MJR Collections after it went R9 or was 180 days late. You must have signed a cardholder agreement in order to get the Mastercard in the first place.

The assertions you state make no sense, I'm afraid. Better call CT Mastercard at 1-800 459-6415 to staighten it out. And for Pete's sake, unless you are a masochist, don't tell them you were mentally ill when you signed for the card.

The available credit is right from Canadian Tire and NOT MJR. In fact, the monthly bills I am still receiving tell me I'm a payment behind and nothing about my account being closed.
This is what confuses me the most because MJR is claiming the right to collect, while Canadian Tire, in all the written correspondence I have from them, indicates NOTHING about my account being in collections or closed.
As for the $800, that's gone back to the poker room, because when they didn't accept the offer, my friend withdrew his to feed his addiction.
So do I believe the current bill from my creditor, or do I believe MJR?

Just a comment about Canadian Tire. I also entered a CT store last year and was given the same line about a gas card you can save on purchases of gas.Nothing was ever mentioned about it being a mastercard.A couple of weeks later i received the card and it was a mastercard. I kept it but it looks like the way they are promoting the card it seems a bit deceptive.

For someone who is ready for the psych ward, you express yourself pretty coherently.

Needless to say your credit with CTC is shot and no, you do not have any more credit with them no matter what MJR says. As well, your credit score has taken a bad hit. CTC reports to both TransUnion and Equifax. so it will be on both reports.

DO NOT GO AROUND TELLING CREDITORS OR COLLECTION AGENTS THAT YOU WERE NOT COMPETENT TO MANAGE YOUR AFFAIRS WHEN YOU TOOK OUT THE CARD. Also, don't tell them that you are under any kind of medical care, physical or psychological.

Creditors will take note of that and may even stick it on your credit reports and then you'll really be screwed. You won't be able to negotiate any financial agreements in the future with anyone without a doctor's certificate attesting to your mental competency - and maybe not even then. You won't even be able to order a phone line.

The 800 bucks seems like a decent offer. Tell them to take it or leave it. If they don't like it, their lawyer knows where the Small Claims Court office is. Conversely, if they do accept it, make sure you get a SIGNED written agreement IN ADVANCE stating that it's in full payment or settlement of the account.

And don't blather on to anyone in the future about ANY of your illnesses. Anything you say CAN AND WILL BE USED AGAINST YOUR FUTURE CAPACITY TO OBTAIN CREDIT.

MJR and Canadian Tire

I have a question regarding MJR Collection Services Ltd. and my Canadian Tire MasterCard.

Actually I have many, but some of them probably cannot be answered here. Last summer my wife, daughters and I went into Canadian Tire as we needed some items. Upon entering the door there was a stand there with a sign, "Sign up for a FREE gas card" and the salesperson indicated it was equivalent to my current PetroPoints card and could be used to get points for purchases and give a discount on gas up to 10 cents a litre (Quite tempting with gas over $1/L) All she did was ask my name, for my Driver's License, and then had me sign and gave me a pile of coupons which made my purchases that day absolutely free.
I receive a MasterCard and decide it's because they want customers so I keep it, besides I needed a new bed and didn't have the full amount to pay. My first month's bill never comes so I call the number on the back of the card (They know my address because they sent the card) and they say they will issue one right away. That afternoon calls start coming in about missed payment, yadda, yadda, yadda. A week later, still no bill so I call back and they send another one. I finally get it the DAY AFTER the next bill arrives and now have a minimum payment of well over $100. I didn't have $100 to put on this bill plus pay my living as my family lives below the poverty line and could never secure any credit up until this point.
I make a payment that we can afford but that is not enough and it builds.
This spring I get a letter from MJR, not from Canadian Tire saying they have sent it to collections as the last contact I had with CT was that I had a payment arrangement and payments were being made and therefore I was safe from collections.

Problem 1, (the one you may not be able to help with, if there isn't any relief in the fact that this was never told to me to be a credit card). When I signed the contract, and even today, I have a psychiatric illness and was on anti-depressants and anti-anxiety medications. I was not deemed capable by my doctor to even have control of my own medications and I was unable to, without help, handle the demands of every day life. This could be one of the reasons why I didn't realize what they were doing...Because I do not generally go to public places and have panic attacks, but I really needed some items for my car. With the deception at first, and my psychiatric state, would it be possible to have not been able to sign contracts? My wife takes care of all of my business, aside from this because she would let a collection agency bully her.

Problem 2, MJR themselves. At first I am told they are working FOR CT and that if I paid my debt my account would be re-opened and I could continue using it. At this point we have no money as I am in a long battle with Worker's Comp as they just up and cut me off of my benefits, my meds, and from my psychologist. We are down to my wife's $9/hour job and before this was sent to MJR, CT was told about this as I made those payment arrangements. So they call and blah, blah, blah tear a strip off of me up and down and offer a "huge discount" of $200 from the $1400 bill they are trying to collect. I told them exactly what I told CT, that we didn't have any money and I was paying all I could, and doing it on the same day every month. "Sir, I am not willing to accept that arrangement." Then the usual bull about talk to your family, friends, church. Take out a loan on your house and pay us by the end of the week. We have no money in our house as we haven't had it for a year and the only reason we have the house is because my wife's parents LOANED us the money themselves to get us out of the area we were living in where 3 murders took place within a year. Nobody was willing to loan me the money, so I called in a favour.

I have a friend that had just won some money at the casino, not much, but some. He said that as a 1 time offer, he would GIVE me $800 if it would FULLY SATISFY the debt. I tell this to MJR and it is unacceptable, even though it is greater than 50% of the debt ($1200 in principle). I told them to take it to CT and they said, after a long discussion, that they would and would call me back. 4 days passed and then calls started saying I wasn't agreeing to anything, and the rest of their crap. I sent a Cease and Desist as they were giving me panic attacks and threw my BP through the roof.

Over this time I have continued with my agreement with CT and still receive bills from them and the last one, sent just about a week before my last letter dated from MJR even indicates an AVAILABLE CREDIT.

Received on August 14th I get a letter dated August 7th stating "my account with the above noted creditor has been forwarded to this department to be prepared for court and legal proceedings." There is then the you have 7 days from the date of this notice (which is the date I received the letter, which I have heard is Standard Practice with these agencies). It also indicates, "Any further action against you will be reported to the appropriate credit bureau and will likely result in having legal court costs awarded against you and your credit rating being severely and adversely affected. Should judgment be awarded in the above matter, it may result in a garnishment of wages, a property lien or seizure of assets."

It then asks me to call them to discuss resolution of this matter or if I feel there are any special circumstances that should be known and failure to respond will result in further action.

Who do I believe, my bill from Canadian Tire or MJR and how the heck do I get MJR off my back as their little phone number came up on my call display today WITHOUT leaving a message (Is that not illegal since they have abided by the cease and desist?)

Any help would be appreciated...And for those of you who watch on here saying people should just pay their debts, I agree but I have no extra money. My family puts out 95% of our income right now to the basics of life (Food and shelter). The last 5% goes to transportation for my wife to work at the crappy job she has and this bill. Plus, as indicated above I made a HUGE offer which they just snubbed. In fact, if it wasn't clear above they have snubbed EVERY offer I have made.
