Pretty hard to understand why he wouldn't go to trial over $9K if he knew he was not going to accept a mediated agreeement. Go figure.

Number one rule in court: Never piss the judge off! They're like a god in court. Hell, many years ago, I met a small town traffic court judge in Napanee, Ont. who really believed he was God. I heard he later drowned when he tried walk across the lake beside his cottage.

Even some lawyers themselves, like Conrad Black, forget that rule but the judge always reminds them and gives them lots of free time to meditate on it.

I know this is a bit late on my reply, but I wanted to give you my experience with Mr. Manchester. This happened a year ago. I had tried and tried to make payment arrangements with this guy over and over again, nothing was ever satisfactory to him. So he threatened to take me to court, and because he had me so pissed off by this time. I said GO AHEAD, and hung up on him. I sent them a fax saying all correspondence would go through fax from now on and if I got one more call from them, I would be countersuing for harassment, and to my surprise, not one more call came from them, but nasty faxes. I remember one time when the phone calls kept coming, that he stayed on my voice mail, and told someone in the background, to find out why I was using a fake name, my maiden name was on the debt in question, but had since gotten married, so my "fake name" was my married name, and that was on my voice mail. He did end up taking me to court, but I hired a lawyer to handle my case, and I didn't need to be there for the first hearing. After the hearing, my lawyer called me, said the guy was a piece of work, actually pissing off the judge, try to use intimidation even on the judge, and found out he was pissed off because I didn't show up, and even said this to the judge, when the judge said I didn't need to be there because my lawyer was representing me, he went on to tell the judge, that he was wrong, seriously, who does that. Oh one thing I forgot to mention, is when one of his employees called me, he said the owner was a lawyer and that he knows what he can do within the law, and I said well he obviously graduated at the bottom of his class and barely passed his bar, because he was breaking a lot of collection agency laws. Well since they couldn't come to an agreement, the judge said it would have to go to trial. This was November 2007, and I never heard anything from them again, and they only had 3 months (I think) to file for a trial. The guy is a lot of talk. I hope you got this straightened out, the guy is nothing but a jerk (I have a better word for him, but don't know how the filters work on here, lol)

2 P.M.? Oh brother, what a hoot! It doesn't get much more retarded than that. Right, Jaimiedude00?

It's just my opinion but I would:

1. Have a good laugh at Lord Charles Manchester.

2. Never, Never pay a collection agent through your main banking account. And if you already have or they know it, change it. Either give them money orders or open up a separate account at a different bank, not just a different branch, where you keep just enough money in it to cover your cheques to them.

3. Small Claims Court Statements of Claim are generally mailed out to your last known address via regular mail. Most of the time, collection agents, when they threaten you like that, are really telling you they have no intention of taking you to court. In any event, if Sir Charles calls you again, make sure you pass on to him the address of your local Small Claims Court office.

4. Maybe also suggest that he do something more useful with his life like scrape dead animals off the highway.

Now, before I start, I don't want to paint myself in a glowing light of innocence, there were many calls I missed or didn't return from Donna at Canadian Debt Recovery Ltd.

But, once we started speaking I agreed to send 3 post-dated cheques, to go along with my work's pay system. To start paying them back.

I was given some advice, that before I send out my cheques, I should request a letter with the amount that I owe on it, so I have something, to work on from my end. And everyone can go home, happy, not ripped off.

Anyways, so I got this letter and sent my payments and I thought everything, was finally, starting to get sorted out, when I abruptly got a call from CDR and was transferred to a man, who asked me to just call him "Manchester".

He played a lot of games with me, but here was the run down of the conversation.

First he asked me to have new cheques couriered to him, today by 2pm. I told him I can't do this. I gave him honest answers, that weren't god enough for him, as to why I couldn't and his answer, was finally "you have to do what you have to do, and I have to do what I have to do", implying he was going to begin suing me, by 2pm today.

Second, I was told that he would automatically get a 20% wage garnish and was even so bold as to tell me that he was going to find which restaurant I work for and serve the papers to me inside the kitchen.

Then he asked me why I changed my address, and I made a sarcastic comment, that it wasn't some illusion, that I had created and that I had moved. But he got quite upset about that.

A lot of other pointless things were said, and as I said I'm not innocent in this situation and may have let a few comments slip towards Mr. Manchester, but I'm 100% willing to take responsibility and pay all my debts fully. But when it comes down to it Charles Manchester is a very angry person who uses lies, threats and manipulation to try and get money from you as soon as possible.

I've been told by a lawyer, that they can't come to my workplace and need a court judgment to get garnished wages, and even that is the last step. But I'm still quite nervous. Talking to a human being like that just makes my spine shiver.

If anyone has any advice for my situation or dealing with CDR/Charles Manchester, that would be great.
