They are taking me to small claims court in Barrie. I fear a lien on my house or a wage garnish. I had no success at the settlement conference, but I hope to have some with the OPPT courtesy notice. Here's hoping.

Hi I am currently going through this same issue, I never missed a payment, the money was in the bank but they did not even try to withdraw anything out of it in january I even have my Bank satement as proof, I am not sure what I should do next Ive spoken to Rubenstein siegal and they are no help also I have the money for the mortgage but no one is accepting it from me they wont even tell me the situation why my file was sent to the lawyers its the banks fault they didnt take out the money ,we will be going into febuary and the money for mortgage is in there but im not sure if they will take it now so that will make me 2 months behind because of the bank not taking it out. Does anyone have any suggestions in what I should do pls help

Quick update on our mortgage situation with The Bank of Montreal and there Lawyers Rubenstein, Siegel they taught they were picking up a free property, but with my 3 lawyers and professional broker/ bankers, we refinanced our property and paid Bank of Montreal off. The process took us about 4 months, plus legal fees. For more info you can contact me. There still is outstanding matter of unaccounted funds by one of Bank of Montreal employees, which they have not addressed.(Whitby Branch), and another Broker from MORTGAGE ALLIANCE.
By putting our mortgage into default by not accepting the payments on our mortgage, Bank of Montreal taught this matter would go away.

Rubenstein, Siegel and there staff were very helpful in providing the necessary information to my lawyers, they are only following the instruction of Bank Of Montréal

Dear Sir,

I have a huge problem which unfortunately is related to Rubinstein and Steigel. Mymortgage instalment did not go through because my Banks mistake, now my mortgage company equitable trust has sent my files , they say , to the Rubinstein steiel,who is now in charge. They are asking for last month instalment and the penalty fees including 420 dollars for themselves. they want me to come to toronto office tomorrow at the latest to pay 2200 dollars! I am in europe right now.. please help!!!!!!!!

We are going through a similar situation and neither Rubenstein Siegel nor BMO is telling us what the issue is. They are being very secretive about this whole thing. We are currently fighting this "issue" through our legal counsel.
Maybe there are more of us out there who are going through this nightmare and have young families to protect.
Its time to fight back! Together will bring more strength.
Anybody out there who are going through this, please respond so we can put an end to this once and for all. Fighting this individually will drain our finances.

Wow thats a total train wreck. Sorry to hear that, I'm not sure you will find a lawyer to take this on contingency but you can always ask a few...

I can tell that that the media would eat this up and run the story for sure. They love to slam big banks when they can.

I would suggest a letter to the bank ombudsman, employee's you dealt with and any lawyer they involved and suggest going to the media with this story if they don't fix things right.
