I just got a call today from ARO to pay off my zellers credit card that is over 6 years old. Out of nowhere after 6 years all of sudden they want there crappy $300 bucks which is now $900 because of all the interest! Luckily for me I was stressed out because I stay at home with my 4 children (3 under 3) and have no income and my husband is going to school and has no income right now...I was looking on the internet to see what my options were and I came across the statute of limitations. I keep seeing in all these posts all over the internet that it is 2 years in alberta. I have emailed several lawyers to confirm that so if that is true than I think zellers is about 4 years too late! And it's so funny because it was so hard to get that hurtin card in the first place.

So sorry if I mislead you with my first post - it has been four months that I have been working on getting errors fixed. Not four months since I requested report... although in the case of TransUnion it took them almost that long to send the credit file I requested.

I did call the Alberta Consumer protection branch today regarding my dealings with Zellers. The consumer protection branch claims that is not part of their mandate and I should file a complaint with the better business bureau.

So once again it seems that a good deal of the legislation and agencies meant to protect consumers are nothig more than a front. The consumer Protection agency advised me to have equifax put a 50 - 100 word summary of my position of the dispute between myself and Zellers on my Credit report or begin civil action. Anyone know a good lawyer willing to work cheap?

If it's taken you four months to get your credit report from Equifax, you should complain, in writing, to your local Consumer Protection and also the Federal Privacy Commission Federal Privacy Commission

By law, both Equifax Canada and TransUnion Canada must give you a copy of your credit report by mail for FREE. They can't charge you for that service.

They may be holding you up for various reasons. The best thing to do is write in again to Equifax and TransUnion.. Sometimes they "lose" your credit report request.

With regards to HBC Canada and Zellers, they were some of the nastiest people we have dealt with with regards to credit repair.

As I mentioned in this post Caution: HBC (Hudson's Bay Canada) card is a department store card and is not regulated by Provincial of Federal Government as to what they report to Equifax and TransUnion.

The best thing to do is complain about them to Consumer Protection in your province. Please keep us up to date with your progress.

Into month four of trying to get my equifax Credit report errors cleared up and now on to chapter of Zellers. In April 2002 I filed registered consumer proposal. It was defeated by creditors in June 2002. Zellers had been one creditor to support the proposal. With the help of a lawyer I negotiated an informal proposal offering so many cents on the dollar. This time all creditors agreed. Trust cheques were issued from my lawyer on March 31, 2003 paying out the agreed upon amounts in full. Each creditor was required to provide me a statement in writing that they did accept the cheque as payment in full. Zellers sent my lawyer a fax saying they accepted my cheque as payment in full. The fax had my full name, account number and was signed by an employee. Equifax is reporting that there is an amount owing to Zellers and encouraged me to contact Zellers to discuss. Equifax had already discussed the matter with Zellers and was being told that the reported information was correct. I contacted Zellers and left a voice mail message for the woman who had signed the fax sent to my lawyer. I indicated I had a copy of the letter sent to her from my lawyer and the fax she had responded with and that I was confident this was an oversight and could be corrected quite quickly and to the satisfaction of us both. Within an hour I received a call back from a man who swore at me, told me to shut up, asked me if I was dense or stupid and asserted that Zellers had not agreed to accept the payment as settlement in full and I should just pay my GD bill if I wanted it off my credit report. When I tried to speak or read the fax, or say anything he interupted me and belittled me. He said that Zellers had agreed to the registered consumer proposal that had eventually been defeated and had never agreed to proposal from my lawyer. I did tell him of the fax I had from his coworker and the wording ...payment accepted as settlement in full.... and he told me it meant nothing. He said that Zellers would continue to report the account with a balance owing indefinately. I suggested it may be necesary to resolve the matter in court and he laughed and said go ahead. He then told me he would be contacting me again and again until I would pay. (Fortunately, I am aware that Alberta legislation (Fair Trade) has a statutue of limitations of 2yrs on debt.) The amount is for 112 dollars. Peanuts really. I am sure he would love me to pay it not only to get the money but so he could continue to report the account for another six years. Gotta love Zellers!
