RE: What you can use for proof of last payment

Postby OttawaEng » Thu Mar 11, 2010 08:00:12 PM

i know this topic is a bit old but i have a similar question.
i have some charge off credit card accounts on my equifax report .
i stopped making payments on those accounts on about September 2004, however the equifax report shows the date of last activity to be July 2005 .
this i guess will extend the purge date by about 10 months.

can i dispute this with equifax?
is disputing those items are going to restart the statute of limitation period again ?

What you can use for proof of last payment

Postby gillian25 » Fri Feb 01, 2008 05:46:27 AM

I can only speak for what I am using however and when I phoned equifax they stated that this is proof enough. However you can easily call them if you have any enquires at 1-877-323-2598.

Here is my situation.
I have been purchasing my Equifax credit reports since 2004, printing them out and storing them in a binder. Only until this last year have I educated myself in regards to Limitations periods, FICO score, and items on my credit report.

Back in January of 2004 was the first report I had purchased and printed out. It listed the original creditor under the Credit Information section (where they list all credit cards, Installment loans, etc)
The original creditor reported Date of Last Activity: 2001 - 08.

It also listed the 3rd Party Collections agency under the Collections section which listed the date of last payment as 2002 - 05.

Knowing that this was the collection agency that had taken over this particular account I was confused as to why the dates were different.
I simply used a copy of my old credit report showing the difference.
The girl I spoke with at Equifax stated that the collection agency can NOT do this and it will be changed by sending in the proof ( a copy of my Jan 2004 equifax report) to them. (highlighting or circling the 2 dates in question)
I also asked the girl at equifax if they needed proof that this Collections account was for this particular Creditor. She stated that they would know who the collection account represented and that no proof is required.

I have to mention that the original creditor somehow no longer showed up on my credit report the next time I had purchased my report later in November of 2004. Now I am not sure why the original creditor pulled their name off of my Equifax but I'm glad now that I had printed my report out when they actually did report because this was the only proof I had that disputes the Date that the Collection Agency has changed.
I sent my information by snail mail, however I believe you can fax copies to equifax as well. If you check out their site they have a link to fixing errors on reports and you can print out the form you need to send, along with copies of ID and the proof.

Oh and if you are interested in what Collection Agency has done this..(probably something they will do if they can get away with it).. the Collection Agency Starts with a "C" Ends in an "S" and has an "R" in the middle. big surprise!!

What kind of documents do you need to present to prove your last day of activity?

Just a note on last dates of activity as I have found an error in my credit report and have sent off my request to have it changed to equifax.

Last day of activity is THE LAST PAYMENT or activity made on the account. If you have never made a payment to a 3rd party collections agency then the last day of activity is the last payment made to the original creditor. I encourage anyone to cross check the original creditors last date of payment vs. last date of activity the Collection Agency posts.

I had a collection agency move the date 9 months ahead of the actual last date of payment.

However, if you have made a payment to the Collection agency or acknowledged in writing that the debt is valid then it would be the date in which that occured.
SOOOOoooo....
I have spoken with Equifax after discovering the error and as soon as they receive my information they will change it.
Hope this helps someone waiting for items to purge off their reports.

Hey gillian25,

It seems that you've got your answer here... (sorry for the delayed response.) If these items are going to be purged in May 2008, that should be the end of that. It sounds like all of your debts are past statutes of limitations any way....

Best thing now is to get good pieces of credit listed on your credit report.

Well I am going to answer my own question for what exactly is "last day of activity" in regards to my collection account that shows up on my Equifax credit report.

First thing I did was call equifax and request a free credit report. You can do this simply by automated telephone service 1-877-323-2598 and follow the prompts. Besides personal information you must provide the automated system it also requires you to have a major credit card, used for only identity purposes.
I received my report approximately a week later by mail.
In the report it will give you a reference number.
I called Equifax and spoke with a real person who asked for the reference number from my report.

Equifax stated that in regards to the collection account it will be purging off the system May of 2008. Which it lists was the "date of last payment" assuming that was the date of last payment to the original credit grantor. The date the collection agency reported it to them has no effect on the date it purges from public records.

Also I may add that even though this free credit report sent to me was not as Aesthetically pleasing as the $17.99 one or the fancy colored graphs $32.99 FICO score power ones that I've been purchasing online since 2004, it does list detailed information about each account and gives you what each account rates you on that R-1 to R-9? scale... which the online ones do not have.

Hope this information helps someone.

What exactly is "last day of activity" on my Equifax

Postby gillian25 » Wed Nov 21, 2007 07:00:09 AM

I have been receiving my Equifax Credit Report since 2004.

2001 split up with my boyfriend, had to move out of province, cost me money I didnt have at the time and therefore put most of my expensenses on my credit cards.

Previous to this I had never had to deal with any collections and always paid all my bills on time.
In 2002 after trying my hardest to keep up with these credit cards of 20+% interest I got behind and 3 were sent to collections.

I have settled with MRJ (paying only a portion of what was owed) and 3 years after my payment settlement date this collections item purged off my equifax.
My intentions were to pay all of them off but had a change in heart when CRS stepped in to be the representative of my Canadian Tire account. I would recieve phone calls at least 3 times a day at one point, was sworn at numerous times, hung up on, harrassed at work, the creeps from CRS also disclosed an incredible amount of private information to my roomate at this time in regards to this debt, telling her that a laywer will be contacting me and that I can't run, how Im a horrible person.... list goes on. Needless to say after about a straight year of dealing with these morons I came to the conclusion that I will NEVER pay them as long as I live.

So back to the orginal question.
Contact Resourse Services is the only reported collection account on my equifax credit report at this time. I still have one other collection account persuing me (ARO) but they have never shown up on my equifax report. I understand that the CRS collection account will purge off of my credit report "6 years after the date of last activity"
However there has not been any activity.
So my question is 2 part.
Taken from my EQUIFAX credit report 0ct 2007
Collection accounts
CONTACT RESOURCE SERVICES
Date assigned: 2003-08 Account # ***********
Collection Agency: Contact resorce services

Date of Last Payment: 2002-05

Date Paid: (nothing)
Date Verified: (nothing)
Comments: (nothing)

so will this purge on 2009 08? (date assigned)?
or
will this purge on 2008-05 (last payment)?
*please note I have NEVER made any payments to CRS.
Question 2
My ARO account has never showed up or reported on my equifax.. its been YEARS..Can they report it 6 years after to equifax?

Any feedback would be appreciated
Thanks
