I was just curious as to how long this stays on my credit report. I'm still debating about what to do with it.

First default being missed payment or date of reporting? The difference is almost 11 months in this case. By the way, I have never spoken to one of their fine representatives or acknowledged their calls which are quite amusing somedays.

That's not the question being asked. There are already several rather long posts answering this troublesome question, which explain the different sections of a credit report and the purpose of the unique 6 digit reference numbers that are attached to each debt by both bureaus - and stay with it no matter how many times it gets sold. It's too long to type out from scratch, but the short answer is:no. For Saskatchewan and most of the other provinces, the limit is 6 years from the date of FIRST default.

I checked my report today and although the date of last activity was late '09 it wasn't posted untill aug '10. I have the statement with the last activity on it if that's important. Also, it was reported again by the last collection agency at the end of '12. Will it keep getting reported each time it is sold? How long can it stay on if this is the case?

Tell them your plan is to let a judge decide the case but DO NOT tell them now you will be relying on the SOL.
Also periodically check your credit report to insure they have not slipped by a default judgment...has been done many times before.

No problem ...they are just trying to scare you.
Until you recieve a Statement of claim...do not lose any sleep.
If they do serve you which is not likely your Affirmative defence is the SOL.

I just got a call to "lawyer up".because I will be contacted in the next few days and better have a plan. It has been passed on to the third person from this company. The one thing I notice as it moves from agency to agency is they have less information on me. I've never aquired a credit report but I think I should soon. What should I be paying attention to?

Sir again....if this debt had a last activity of 2009....2 yrs has passed... it is Stat barred. Further once a Statute has expired it CAN NOT be restarted regardless what you do. The act is quite clear....an acknowledgment of the debt must be made prior to it running out.

They could still file without your knowledge and obtain a default....but if it goes to trial you have an Affirmative defense....the statute...it can not succeed.

If it is indeed stat barred, then you can just sit on it and do nothing...but make sure you do absolutely nothing. Paying even a single dollar restarts the statute of limitations, so the date you need to be thinking about is the date of last activity (i.e. last payment you made) not just when the account was opened. Make sure you consider this in your calculation of whether or not this debt is stat barred or not. If it's not stat barred you could end up with a judgment before you even realize so make sure you find out for sure that it is past the statute of limitations before you decide to take the ignore-them-completely route.
