No, I didn't comment on the CBC story. I have sent them a letter of dispute over this issue and have not heard any more from them. Not sure if they are trying to get a judgement or not, have not been served with anything as yet. Time will tell.

Were you the same person that posted a comment on the CBC story from late last year? Excellent if you did...these charlatans need to be exposed and restrained from reporting libelous information.

By the way, Maria Pozza and "Annie White" lol are impossible to deal with. I used a cease and desist letter against these jerks.

They say it is $900 and change, don't remember the exact amount. I figure they are just trying scare tactics. I just want to be prepared.

Obviously they have not filed yet and chances are very slim they will.
Again just trying to scare you into a payment.

How much are they claiming you owe?

You would file the motion at the court in which the case was heard.....you would find this out at the clerk of your local small claims court.
No you would not need a lawyer.....you would simply state you were un aware of the court date as you were not served a statement of claim or any other documentation from the court.

Can the motion to set aside be done at any court and can you do it yourself or do you need to hire a lawyer?

They are trying to intimidate by making it sound like they will recommend to Telus to sue.
Funny thing is telus has been out of picture for long time.
It is not un heard of for collections to launch a suit and lie about serving defendant then obtaining a default judgment when they do not show for court.
Periodically check your credit reports to be sure no default judgment has been registered. If by chance one does appear somewhere down the road file a motion to have it set aside.
This usually must be done within a couple mths of judgment for the courts to seriously consider it.

So the tale continues. I have been ignoring the calls from CBV and now they left a message saying I had to contact them before this Thursday otherwise they will be forced to "make a recommendation without any further contact".

What would this mean? I presume they mean they will take it to court without any notification to me. How do I know if they file a claim with the court so I can counter with SOL?

You will need to be able to prove to the 2 reporters that this is an error. To bad you lost the paper work.
Only if you can establish that this is an error would they remove it....else it is there for 6 yrs from time of default.
