A needless distinction since the limitation period has been 2 years in Saskatchewan since 2005, and also 2 years in Alberta since 1999 for this type of debt. The Alberta limitation period is the applicable one since that's where the contract occurred and service took place.

Who's jurisdiction.....

Postby Lilbastard101 » Mon Jul 16, 2012 10:39:06 PM

First off I wanna say this website is very helpful. Thank you to those who take the time to read an answer the questions people have.

I'll spare the minor details of my problem and get right to the point. I had a Bell contract in Alberta 3 years ago. Due to Bell being lazy(my guess) I didn't get a final bill from then when the account was cancelled. A few days ago I got a phone call from D&A collections informing me that I owe them 660$ for the over due account and when they could expect payment. I told them I had no knowledge of this debt and that I needed to speak to Bell. I called their customer service and sure enough I had an outstanding balance. I also found out my last payment was Oct 2009.

Ok now to the point if my question. I'm living in Saskatchewan currently. As I understand it since the contract was signed in Alberta it falls under the 2 years SOL and they can't sue. What I wanna know is who's rules do they have to follow about what time they can call and licensing etc..... Does it fall under Alberta where the contract was signed with Bell or with Saskatchewan since they are trying to collect in that province. I'm asking because the collector was fairly ignorant to me and went on about suing me and seizing my bank accts and would like to file a complaint. I just need to know wich province I make the complaint to.

Oh and I have every intention of paying my debt back to Bell even though they made the mistake. I just don't want to give the collection vultures a dime. Any tips how to do that would be appreciated. Bell won't talk to me they tell me I have to deal with the collectors.
