Oh dear sounds like you fell for one of their evil tricks of the trade.
Engage in a debt settlement immediately. An 8k offer is reasonable based on industry standards but it all depends on your personal financial wealth:

Do you own a property or properties?
How much do you earn annually?
Do you pay child support?

Lots of variables to consider.

If infact 6 years had not passed....then sorry to say you got sucked in to renewing the limitation period for another six years.
The 25 dollars was not a good will gesture as they claimed but rather an eraser of any time that had past.

Assuming atleast 6 years had past prior to your 25 dollar payment....once a Limitation period has expired it cannot be restarted again with a payment. And again after 6 years the debt legally does not exist anymore and they are violating the law trying to collect an extinguished debt. This applies only in BC and NFLD.

When was the last day of activity of this debt prior to your 25 dollar " goodwill payement"?

Unfortunately, that last creditor convinced me that paying $25 or more per month would be helpful to show 'good will'. So I did. Which deleted any years prior for SOL.

What, if any percentage, should I negotiate???
Will they really sue me?

I have read that anything over 10K they will go after.

Thank you for your help everyone.

Exactly how long is years ago. The Statute of Limitation is 6 years and then the debt is extinguished...it no longer exists and is illegal to try and collect.

$24K owed, CollectCorp calling. Help?

Postby mrsSmith » Fri Oct 14, 2011 05:07:07 PM

Anyone have information on how to deal with this collection agency to negotiate a debt settlement?

This is the third agency to have purchased my debt. It is from a BMO Mastercard from YEARS ago...and I was unable to pay it back.

I am currently trying to get a loan in order to settle it. Was going to offer about $8,000.

Would appreciate advice on how to deal with these people.
Thank you.
