Every year, a number of people elect to take a 401(k) loan, an early withdrawal from their 401(k) account, which they have to repay. Unfortunately, an increasing share of these loans isn’t paid back, as the quantity of 401(k) loan defaults has risen in recent years. Article resource: british payday

They are infact one in the same company....you can check it out online.
There is absolutely no requirement in law for them to need to send you a copy of an inter office memo....except to show you some huffing and puffing.

Again...till you see a Statement of claim....don't lose any sleep.

Still just a useless document meant to intimidate..
If and when you recieve an official statement of claim then you can react.

Hi TJ, they have taken their 'next step' now, so to speak.

I believe it is not a Statement of Claim. I found an image of a statement of claim here http://www.bankruptcy-canada.ca/trustees-talk/bankruptcy-alternatives/20101122/draft-statement-of-claim-more-on-the-story.html

It is a letter from CCL to Metro Legal advising authorization to file suit (Notice of Authority to File Suit).

I believe they might wish to confuse the issue by indicating communication between CCL Financial the collection agency, and Metropolitan Legal Admin Services which seems to be part of the same company. Phone # verifications seem to indicate they are related organizations or at least in the same building.

Have you seen this type of thing before? Is it just more 'bullying tactics'?

It has been my experience in civil matters that by the time all discoveries and pretrial meetings have taken place it has been 18 to 23 mths before it arrives in the court room for trial. I am sure some are a little quicker but not much. My point was...until I have a Statement of Claim....all the threats of lawsuit are meaningless. And once I have it there is still lots of time to negoiate before it hits a trial judge. Court dockets both civil and criminal are severly backed up so the notion that a trial will take place in a few months is just not realistic.

TJ.brooks,

what do you mean when you say:"I never worry about court proceedings until I have a valid Statement of Claim in my hand...even then leaves 1-2 years to negotiate" ?

Does it take that long for both sides to get to court once you get confirmation that they are going to take you to court?

One other thing....demand proof of the debt...not just their say so.
Chances are they have no documentation as creditors are reluctent to provide it...So if they can't even prove the debt to you...they will have a very difficult time proving it to a judge.

Without documentation any one could call you and say you owe me money.
