If a payment was made in May 2010....it will not be barred till May 2012

Before the $100 I paid my father made two payments one in May of 2010 and the other in January of '09.

Yeah. It turns out that my dad had put some money on the account a while back. I called Scotiabank to see whats what.

I sure do hope you're right about me not being sued. It would kill me financially.

Wow. So I did some digging today and it looks like this debt isn't stats barred.

How likely is it that when the debt case gets forwarded to the lawyer he will sue me? I'm unemployed. I don't have any money laying around for a court case. This is absolutely insane.

Honestly I don't know how long the collection agency has had this account but it has to be more than 3 years now since that's the last time I had a credit card and when I cancelled my card I assumed that the balance was at 0. So I'll assume that the last time I made a payment on it was at least two years ago. (This has for sure taught me a good lesson.... KEEP TRACK OF EVERYTHING)

Oh well. If they "take me to court" then they take me to court. I don't see what that will accomplish however since I don't have a job. It's like trying to get water out of a dry sponge at this point.

P.S. They don't seem interested in agreeing to a payment plan. (I just called them to see if I could get one IN WRITING) So I guess I'm screwed.

Thank you for your help DanielBI. You have made a lot of my stress over this all but vanish but I have a few more questions.

This is my first time in any sort of trouble with a collections agency so what exactly is the two year limitation period and what does it mean when your debt is stats barred?

Also what happens now since they strong armed me in to giving them a good faith payment?

I just want this debt gone. Do they have to accept a payment plan if I offer one? I mean I can do about $30-40/wk on it. But there's not a hope in hell they'll be getting a full payment from me. I'm getting married in September. All my money is spoken for.

So for the last month of so this "lovely" lady from CBCC has been calling me and harassing me for the $630 I owe on a VISA account.

I'm unemployed right now so I told her I would make a payment when I found some money.

She then went on to threaten me with forwarding my case to Brian McNulty (whoever the **** that is) and that he would sue me for my $630 (thus costing me $1200-$1400 because of court costs)

So I asked her if I could make a good faith payment on the account of $100 and pay the rest at a later date. She said okay and and then offered me a settlement of $430.

Well today I called her to see if I could make another payment and she said that she will only accept a full payment and that if I can't pay it by Friday I'll 100% have my case taken to Brian McNulty and subsequently to court.

Don't they have to legally accept payments? I'm so confused and scared that this is about to cost me more money that I've had in a long time.
