There is no ombudsman for CBV you can access. A flagrant violation of the law. Contact Brian Pitkin's office at 416 326-8802, and maybe he'll give it too you. But, don't expect too much more.
If it's been 2 years or more it's stats-barred in Ontario. But they can still call you about it forever - unless you send them a registered letter requiring future contact by mail only.
Needless to say, they could only sue you if the limitation period hasn't passed, and your name also appears on the deed.
Most "ombudsman" for collection agencies are there for show to meet PIPEDA and other regulatory requirements. In fact, their rotating boatloads of undocumented workers steadfastly refuse to let you know who they are -assuming they're aware of what one is in the first place.
Unfortunately, most of their collectors come from far off lands where compliance with the law is not a top priority. If you don't believe me, call them up and ask for their compliance officer.
Also note, CBV also buys debts under the registered name of "CBV Factored [XXXX] (Telco, Visa etc)." They then own the debt and Sears would be out of the picture. As the debt holder, CBV is the new principal and therefore exempt from following the Collections Act of Ontario. However, CBV Factored XXXX has their collection division, CBV, collect for them and thus they are still subject to the Colllections Act. Not sure if this applies to you.
