thanks Monty,

Can I ask, if the debt defaulted in Ontario, but have lived in Alberta for 6 years, does it fall under the Ontario or Alberta legislature? Also, because they won't send me the info on the file, how do I get details on the debt? There is nothing showing with Equifax (and we just refinanced our mortgage, and the mortgage broker did a pull on both bureaus and nothing came up). I called CIBC and they don't have any info either! I'm assuming that this is well past the SOL but can't confirm since it may have been sold, however, if it's not on the credit bureau, doesn't that mean its well passed?

melissa2... you should call your consumer protection branch and ask what the appropriate times are that collection agencies can call in your province.

also... you should ask the collection agent/collection agency if he's licensed to collect in your province.. if so... please provide proof of that license.

ok...so not only did they call back at 7:15 this morning, but the lady tells me I need to pay now. When I told her that I am waiting for the transaction history and info I requested to be mailed Monday she said, unfortunately if I do that she will be taking the settlement off the table and we will have to pay the full amount.

Last night I received a call from FDR stating I owe them $1500 from 2001. Actually they told me first it was from 2003, and I told them thats imposible they decided it was 2001. They said they could offer to settle. When I pressed that I dont recall ever having a CIBC visa she said "thats why she was calling to remind me". I advised her I have a copy of my credit report from equifax right in front of me and there is no such debt she replied by saying "sometimes that happens". What the heck?? Anywho, I asked for some proof (ie. this was my card with my transactions on it) and she said it was in my best interest to pay before I get that info or else it would show on my credit bureau. Can they do this?
I understand that it is stat. barred, but I don't want them doing inquiries on my credit report from now to eternity either. If I settle to get them off my case, is this something that they can then put on my credit report? If it is it seems silly to pay at all since one way or another they will be inputing info on there. Also, what would be a good amount to offer? Any info would be helpful!
