Alright so either the dealerships people added interest on it or the collections scum is cheating you. You bought this vehicle for the full amount? On credit card? On line of credit?
You do have the receipt of the grand total right? Prove it to them and ask them why they added to it.
Right, in Manitoba it's not worth waiting for the SoL, just do bankruptcy unless you have active credit cards you don't want to lose.
The "one person and now another person" in the office thing is bullcrap they use on you. Most use fake names anyway. Unless its just been passed to another agency. If it's in the same office, the person he was talking with should have "the file"
Since the only "assets" you have are your cars, they probably won't do anything becaue you need those to get to work. So they know you work, and the debt is about 20k It's kinda a gamble whether they take you to court for wages.
BUT! You said they added more, now you have to find out what they added and get proof from them. If you believe they simply added crap to get more out of you than that's evidence you have against them and you should probably ask them to take this to court if they can't verify what and why they added more.
OR stop paying them, save money, and hope they get desperate by sending you a letter with a decent settlement or it may say "contact us, we're ready to deal"
You can send them $5/month if you want and they will probably never take you to court. As long as you keep sending them something it won't go to court. It's all just to scare people, it's rare.
IF you find they are planning to take you to court then you should just go ahead with bankruptcy and be done with it. You have no idea how good it'll feel with a fresh start.
Again try to negotiate, their should be no interest and crap being added on anything when it goes to third-party collections(unless Manitoba is different, doubt it)
So I was right about $20k you owe? If you/he stops paying and they don't take you to court(very rare they do) they can get desperate and offer you about $13000 settlement letter. Again depends on the agency, hopefully they're really desperate and offer around $8900.
