Alright so either the dealerships people added interest on it or the collections scum is cheating you. You bought this vehicle for the full amount? On credit card? On line of credit?

You do have the receipt of the grand total right? Prove it to them and ask them why they added to it.

Right, in Manitoba it's not worth waiting for the SoL, just do bankruptcy unless you have active credit cards you don't want to lose.

The "one person and now another person" in the office thing is bullcrap they use on you. Most use fake names anyway. Unless its just been passed to another agency. If it's in the same office, the person he was talking with should have "the file"

Since the only "assets" you have are your cars, they probably won't do anything becaue you need those to get to work. So they know you work, and the debt is about 20k It's kinda a gamble whether they take you to court for wages.

BUT! You said they added more, now you have to find out what they added and get proof from them. If you believe they simply added crap to get more out of you than that's evidence you have against them and you should probably ask them to take this to court if they can't verify what and why they added more.

OR stop paying them, save money, and hope they get desperate by sending you a letter with a decent settlement or it may say "contact us, we're ready to deal"

You can send them $5/month if you want and they will probably never take you to court. As long as you keep sending them something it won't go to court. It's all just to scare people, it's rare.

IF you find they are planning to take you to court then you should just go ahead with bankruptcy and be done with it. You have no idea how good it'll feel with a fresh start.

Again try to negotiate, their should be no interest and crap being added on anything when it goes to third-party collections(unless Manitoba is different, doubt it)

So I was right about $20k you owe? If you/he stops paying and they don't take you to court(very rare they do) they can get desperate and offer you about $13000 settlement letter. Again depends on the agency, hopefully they're really desperate and offer around $8900.

Okay, here is the story in some what of a nut shell. At the time of purchasing the vehicle it was $17,000 and this was in September 2004. After being passed from Collection Agency to Collection Agency this last Collection came up with a ridiculous amount of what was being owed, something like $19,000 almost $20,000, and this is 6 years later and many payments made later. I know that you keep talking about the 6 year statute of limitations but it seems that he will never have a SOL if he continues paying because it would be 6 years from the last payment made. He is making payments when he can and the amount that was agreed with one person in the office but now it is another person in the office that he is talking with. This guy wants more than what was agreed and yes in order for the debt to now be $19,000+ then they are obviously tacking on a lot of extra stuff!! I would suggest that the ex not send them any money until he got something in writing that they would write of the debt once he paid this settlement fee. We both work, we don't have significant assets. He rents and I now live with someone who owns the house, my name is on nothing there. I own a car and of course he has the truck. What if they were to send a garnishment to our place of work? What do you do then? I am trying my best to help the ex out here because what they are doing is wrong. Especially after 6 years of having the truck now the truck costs more than when it was first bought. It is WRONG!

Well you're still not answering my questions...

What do you mean they "keep insisting more"? Are they adding interest?

Again it's in third party collections (who cares what they think) no law saying you have to deal with a collection agency, you're well within your legal to simply ignore them.

Since you won't reveal (or round) to the number you owe lets say $5000+ is getting significant you should call them and ask about a one time settlement payment. If it's not that much then fine just continuing paying whatever you want, they won't do anything.

If say you owe $10000 and they offer you down to $8000-9000, they're lying. You should get it down to between $4000-6000.

Depends on who you're dealing with, some of these high school educated scum are so desperate they will offer upwards of 80%! off.

Negotiate and try to get them to send a one-time bill in the mail if you can not just verbal over the phone agreement. Pay them with a credit card or certified check or money order I think is best(whatever you can keep a record/receipt of) keep proof. Send it registered mail with receipt and all that.

Thank you very much for your response. You are making me feel much better. My ex is making payments and plans to keep doing so but like I said they keep insisting on more. Should I tell me ex to offer them some money to close the file completely?

Alright then...When was the last payment made? You don't intend to pay it but does he? Do you have significant assets? Do you work? Do you have a car? Own or rent a home? Live with someone else where you are not under the title of ownership?

I guess depends on the company/province, but like 95% of the time they will never take it to court. It's just to scare you. Don't be.

If he's making payments then pretty sure they shouldn't be going after you until he is not making ANY payments.

Doesn't matter if they "want more" they always say crap like that. Pay what you want, when you want. It's already in collections so now you're in control.

Remember you don't have to talk them, hang up.

Do you work? Of course they could always garnish your wages but I don't see them going that far until after they go through your ex.

If you don't give them info it could take about 6 months before they find out where and if you work. Don't share anything.

Either do bankruptcy or if it's closer to the SOL then wait for SOL. Or if it's not that much just try to pay it.

You should get about 60-80% off of what you guys owe. Ex. if you owe $20000 they should have no trouble knocking it down to below 13000$. If you owe $10000, they could easily knock it to below 6 to 4000$.

As long as someone is making payments, they will pretty much never take it to court.

Don't pay for debt help/counselor/negotiate service crap. Talk to them yourself. Both them and collectors are just one big scam company.

If they keep passing it around then they really don't seem to want to take legal action otherwise wouldn't have one of those collection agencies done it already instead of just passing it off to another? The fact that they never ever sent a statement either shows that they are like a loan shark, they could add any amount that they wanted to it and we wouldn't even know because we don't see anything.

Ya doesn't matter if you're not on the truck, you're on the loan then you're tied to it also.

I believe MB has a 6 year statute(beginning from the last payment).

You should look at when the last payment was made vs. bankruptcy

Bankruptcy can easily pass 1-2000$+!

Don't be afraid/intimidated from the scum. Yes that's what they do pass the account around.

I have been separated since 2004 and prior to that time me and my then husband had got a loan for a truck. When we separated the ex kept the truck and said that he would take over the payments. The truck has always been registered in his name. He had some money issues and got behind in the payments. The car loan people started calling me (as my name was on the loan) I explained our situation and that he has the truck and if they have to reposs it do so as I do not have the money for the truck. They never did reposs it. My ex did pay when he could plus the loans people were charging him $100 a month extra for every month that he did not show proof of registration. We never received a statement in all the time that we had a loan on this truck. The car loan people finally passed it on to a Collection Agency. The ex did make payments but always seemed to get behind. He has now gone through 3 collection agencies as they just pass it around. It is now 2011 and a new collection agency has been hounding me non stop. What can I do to stop this from happening, I am not paying for this vehicle, I don't drive it and it is not registered to me. I know that my name was on the original loan but there has got to be something that I can do to stop all this calling. My ex is making the payments with this Collection Agency but they want more. there must be a statute of limitations on this kind of collection. Any advice would be helpful as this point. If they come after me I will claim bankruptcy which I should have just done when all of this started. PLEASE OFFER ME SOME GUIDANCE!!
