Anything tangible or intangible that is capable of being owned or controlled to produce value and that is held to have positive economic value is considered an asset.

Contact the property office and tell them to reverse the ownership of the mobile home. Obviously, there is a communication problem here between your mother and the property office. I would suggest that you take your mother to the property office and get this matter resolved ASAP. If you decide to make an assignment in bankruptcy later, be sure to tell the Trustee in Bankruptcy exactly what happened. Otherwise, if your Trustee in Bankruptcy learns of this transaction later, it will delay your 9 month automatic discharge. The Trustee will object to the automatic discharge and you could remain in bankruptcy for an additional 12 to 15 months before being discharged.

I am studying a bankruptcy proposal I want to offer.

To make a long story short I have about 28000.00 in unsecured credit.

2 years ago My mother (in her 70's) was having trouble remembering to pay her property tax.

The property is a 1974 PMC mobile home. It sits my brothers property.

I suggested that she go and have the taxes sent out in my name. So I would see the notice and remind her to pay.

Something was messed up at the property office. and they transfered the mobile into my name. It is in very poor shape but will show up as my property. Will I still have to pay equity during the bankruptcy process because the property is in my name?
