Go here and D/L my Cease and Desist template. Just update the first line to read: "Pursuant to my rights under ONTARIO REGULATION 103/06," as the act was updated.

I believe the statute of limitations in Ontario is two years. It looks like their time is up. Be aware though that even if this is the case they will still persist. Stand up to them and say you don't give a stuff what they will do and you are NOT going to pay them whatever happens. Tell them you don't give a damn if they put anything on your credit report and they probably won't. If you show fear or let them see your weakness over the credit report they will feed on it.

Maybe you should just send them a letter telling them you are aware the statute of limitations is up and demand they contact you no more. I understand they have to abide by this by law.

Somebody more expert than me will confirm this though.

Statute of Limitations? Help Please!

I have been contacted by a collection agency regarding a fitness membership I used to have.

The agent I spoke with today said that the amount was delinquent in April 2007, and their agency had spoken with me last on October 9th 2009. I am pretty sure I went in and paid the membership off in 2007 – probably in cash. I know. Stupid! I was making most of my money in cash at that time though and I just wanted the matter dealt with. I no longer have any documentation (if I ever kept any of it in the first place).

I refused to acknowledge the debt, and stated that I believed the statute of limitations had expired. The agent indicated it would be put on my credit report, which I would like to avoid. What can I do?
