Yes they could...but first they need to go to court and win a judgement. The lien would then be used to satify that judgement.
What kind of debt is it and when did you last make a payment?

Nameuser is right, they will quite possibly sue - but unless the amount owed is excessive, they'll likely register a lien against your home NO MATTER if there's sufficient equity in it or not. If you have more liquid assets or income, they'll surely come after those (if they win a judgment of course.)

As posted by Nameuser, Global as no right to put a lien on your house, take your car or any other assets, well not yet anyways.

IF they actually bought the debt from the original creditor may sue you,

IF they win they can take appropriate measures (in realtion to the amount due) to get paid.

if they heven`t bought the debt TOO BAD, only the creditor can sue you.

BTW it`s illegal for them to use threats (including the threat of unauthorized legal action) to make you pay. And you`ll never face criminal charges for not paying your bills. it`s not a crime to be broke.

In Québec check the Loi sur le Recouvrement de Certaines Créances or call the Office de Protection du Consommateur, and the statute of limitation is 3 years (Qc) it varies from province to province.

Not sure why the poster below says they cannot make that threat. Considering Global has lawyers that they use to actually sue people, how would the agency not be allowed to tell people that they were going to be sued when they actually sue someone?

Obviously, it is usually a scare tactic but if you're a home owner there is more potential for the agency to go legal.

Do you owe more than 5,000? Is there sufficient equity in your house that they could believe a lien would be worth pursuing to secure the debt?

Is the statute of limitations almost up (ON is two years)?

They do not have to take payments but will with most people (after a lot of hassle and threats) unless they have reason to believe that it could be paid through legal means.

By law, they are not allowed to make these threats, you should file a complaint against them with your provincial consumer services.

Also, remember the statute of limitations gives creditors a certain time period as to when they can pursue you legally. Once the period expires, all they can do is attempt to collect the debt.

I have debt with a credit card company that I admit I was ignoring, but once I received "the letter" from Natale's law office I bucked up and started returning Global's calls. Now I am trying to make arrangements to pay the amount off, they are not willing to offer me a payment plan method, rather are willing to accept the full amount minus the interest (they said they can suppress it). I am having difficulties coming up with the amount and the rep at Global I have spoken to a few times over the past 4 days has told me that their lawyers are wanting to just proceed with the legal proceedings which will most likely result in a lien being placed on my house.
I have a couple questions. One: is this a valid threat? Two: I am wanting to pay off this debt and start the long road of recovery, but they do not seem willing to negotiate with me and I can't seem to find any other options as my credit report is now shot. Is there anything else I can do?
