If you don't recall the debt or balance, you can request the statements or documents to be provided by extreme fitness and the collection agency has to do so. If they won't do it, go straight to extreme fitness for them.

While you're at it, ask extreme fitness if the collection agency is authorized to handle and collect on this account.

There are payment options, depending on your intentions.

I assume from what you say that you incurred at least some expenses for personal training (which is money well spent by the way) and that they screwed up on the billing and/or its collection. 2 years later you're hearing from a collection agent. The debt will be stats barred from court action in Ontario if it's been more than 2 years since a payment was made; not that they were going to sue you anyway.

You should pull your credit reports from BOTH TransUnion and Equifax just to make sure the debt isn't on there. You're going to be looking for a job pretty soon and many companies pull your credit file for employment and always do for renting or financing.

I know some personal trainers where I work out, They perform a great service indeed and they work on commission, not salary. The ones you used may not have been reimbursed by the club if the client didn't pay. Irregardless, apart from legalities, you should try and settle if you are able to at some point down the road.

How old is the debt; when did you last make a payment on it; and what written agreements did you enter into with the health club.

Highly unlikely, you'd ever get sued over this anyway; and they probably don't even report to the credit bureaus,

I hope you're in good shape at least, after all this.

d&a collections corp question..

Postby ppphokus » Thu Sep 02, 2010 07:14:02 PM

Hi all,

So today i got a call from a lady name samantha from D&A. Shes telling me that i have a debt of 1600 from extreme fitness for personal training. I honestly dont recalling owing that much as they take money from my bank acct each month for it. After my contract was over with the gym I stopped makin payments as i did not go there anymore. Anyways long story short..she wants the payment in full but im a student and cannot afford to pay it all off at once...any suggestions? thanks
