Go to Equifax.ca and TransUnion.ca and download your Credit Report. There will be a fee involved which is about $15 each. If you do not want to pay this fee, you can order a Consumer Disclosure Report by mail for free. It will take 3 - 4 weeks to arrive.

When you receive both reports from Equifax and TransUnion, read them carefully and see if there is a judgment shown on either or both reports. If there is, report back on this website with the details. I will explain what are your options. If there is no judgment shown on both reports, then there is no judgment registered against you.

I have a question. I took out a loan (07) with a co-signer to them the co-signer out. He agreed to make the monthly payments. And he did for until we split up (03/08). Now the thing is I have never personally made one payment to the this loan/debt, and haven't agreed to make any kind of payment to them. I was told but someone that I make a payment I am then acknowledging the debt. Is this true?
As well about a year ago I get paper work from a lawyers off saying that they are going to garnish my wages. (too bad I had started my Mat leave) but regardless of that the information they had on there was for a job that I hadn't worked in over 4 years! so I called the lawyer and she said to send the paper work back because she had sent the wrong ones and would send out the correct ones. Well I never received them. Now some collection agency is calling me demanding that I send him proof of income because he needs to provide to his client why payments are not being made. He requested this info because I told him that I have no taxable income. (which I don't) He went on to informed me that there is a judgement against me for the next 20 years and it's only against me and not the co-signer as well.

Here's the kicker he sent me a letter saying that if I don't start making payments that they are going to garnish my wages etc.... Do they have a judgement or not? or do they need to take this back to court because of the wrong information that they sent me?
I'm a little confused on this, Please advise

well because i am unemployed,divorced with child payments and i payed all my creditors though negotiated debt management program. wells fargo has refused to negotiate now they are way past the statute of limitations.
there is no money left,sorry.

I must commend you on keeping the paperwork to show the credit bureaus just in case the collection agency or creditor changes your dates of last payment in your credit file. I would just ignore them because the letters tend not to work unless you get a lawyer to do it.

yes i have all the payment information , as well as last payment. can i send them a letter stating to only contact me by mail?

I misread the debt is four years old and it will come of your credit file in two years. Have you done a credit check on yourself lately? I would ignore them because if you speak to them they are going to be nothing but rude to you especially if they think you know the law. Do you have the receipt the last time you made the payment on the account?

Did you give Wells Fargo your sin number, if so Wells Fargo will give the collection agency all your info to track you down? If you’re talking to the collection agency I would not acknowledge you owe the debt because the statute of limitation in Ontario to sue someone is two years. Do you want to settle this debt or just ignore it for another three years and it will come off your credit file.
