RE: can a collection agency take $ out of joint account?

Hi, TJ....other way around. How can I put money she sends me into her student line of credit? She lives in Brazil, and to transfer $ to her Canadian bank account is almost impossible and costly. I have just been transferring $ from my bank to our joint CIBC acct so that the bank can take the payment out every month. Now any money I put into account is taken by the bank for my own LOC debt, and it messes up my daughter's credit. I'm going to the CIBC bank tomorrow to get my name taken off of her account. I hope they do it, as I don't want my daughter to suffer because of my overspending! Thanks for any advice!

Just make sure you leave no money in any branch of that bank....else it will be gone.
Your better off setting up a paypal account and transfer money to daughter via email.

Thank you to you for your reply and thank you Hank for all of your advice. I am not going to accept the deal from the collection agency. It just doesn't feel genuine.

Don't do it till you have it all in writing.
Don't do it at all if you do not want to.

Thanks, just got off phone with CCA, a collection agency for CIBC. They want me to go to one of my credit card companies that I've already settled with to get them to pay what I owe to CIBC. I was given 15 minutes to do this and if I was successful, they would take $1000 off of what I owe. Of course, the credit card people have settled with me and I'm paying a set amount every month. I feel as though I'm being scammed!

Then what the bank is doing is using their right to setoff which does not require a court Judgment. Perfectly legal....a pain...but legal.
They can continue to drain the account regardless who else has their name on it until outstanding LOC is paid off.

Do not deposit anymore money into this or any account at any branch of this bank..

This has nothing to do with this being a student loan.

Thanks again, Hank! The line of credit was not defaulted on.......I was sending money from another bank to make the interest payment every month, as my daughter is still taking courses for her degree via distance education. So the student line of credit was still good. But what the collection agency has done is cause a default on the student line of credit by taking money out of my daughter's and my chequing account. Thus my daughter is being penalized over my debts. I will take your idea of using a money order to make payments on the line of credit, as it appears they will continue to use this method of getting money. They can do what they like with me, but I don't think it's right to penalize my daughter!
