The best thing to do is ensure there is no money in any branch of that bank that issued the card, as they can take it under Right of Setoff laws without any court proceeding.

Thank you for the reply. I was able to cancel my wife off another account (credit card with a balance of approx. $16,000). I hope the bank won't be able to go after her on that... Should I be concerned?

Yes...since she is on joint account they will go after her for full amount.

Hi,

Me and my wife separated about 9 months ago, but haven't signed separation agreement yet. We still have a joint line of credit with a balance of approx. $12,000. The bank refused to take my wife off the account. If I declare bankruptcy, will it affect my wife? I wish to be solely responsible for this debt
