Me....I would forget the CP....wait for trial....get some favourable terms from the court since you are unemployed. The other 40 g's can wait till some other time when you are back on your feet. If they are stats barred all they can do is phone....hang up they can not win in court.
But that's just me.

other than the 10k the rest is justed stat. barred but bought by different agencies. BDO said I need to propose to ALL creditors and hope will get majority accepted. My trial is next week and I am unemployed for a a year. I am just so sick and tired dealing with the collection people so hopefully getting a CP will give me peace and a new start.

When you say pending, have you been served a real Statement of Claim from the courts?

If the 9500 is before the courts you will get a reasonable payment plan based on your ability to pay.
The balance no one can go after you for ...just hound.
Bet the advisor will not mention that as it cuts into their 20%.

If they are more then 2 yrs and you have not made any payments on them then they are Stats Barred and you are not required to do anything with those.
Don.t assume there is no cost, they still provided a service and will expect something. Make sure of total costs either way.
Are you presently working earning a good wage?

Thanks TJ for your reply. Other than $9500 with MBNA (went to collection and pending trial) the rest are more than 2 years. I would assume there will be no charge if the proposal is not accepted. In that case I will need to file for bankruptcy and pay the fee related to the service.

How much is the charge if the CP is not accepted, as there is no guarantee it will be?

How old is the debts?

Anyone has experience with BDO Canada? Are they a reliable company? I have a consultation with one of their advisers about filing a consumer proposal. My debts have grown to become a monster that I will never be able to pay off in my lifetime so my options are either CP or bankruptcy. BDO fee is about 20% on my monthly payment. My total debts is about $50K. Is it reasonable to propose $200 monthly for 5 years? Please help!!!
