I was just reading up on the real easte information for Nova Scotia. This year there is an expected drop in Halifax of 6.1% and they are stating it is going to take at least the next 2 years to get above the 10 year average....................so I live in Halifax.....normally I wouldn't be happy to read about the real estate market not expected to do well......but I believe these numbers would fare well for my individual situation? Assuming the markets reaching the 10 year average in 2 years doesn't mean a huge increase.......I really am not sure of what that means?

Anyway, Im holding onto my hat that I wont have to worry about this, fingers crossed!!!!!

I will try to get them anyway, I would rather be prepared. Hopefully I won't need but better to have in the event I do need them.

They can not prove the debt without them.

The credit report you received has date....but again try to get original from credit card company....in any event the Plaintiff would have to have them.

Having said that the collection agency would need to prove the debt and would need to produce these statements including when you defaulted to prove their loss.

Actually a copy of credit report does not have to be accepted because it is hearsay evidence.
Judge can make exceptions to the hearsay rule specially in civil court....however he does not have to.
He or she can give what ever weight to it they wish.

Hi Hank..,,,thanks again for the reply, great clarification! I don't actually have a statement to show the date it went into default but the credit bureau is bang on correct with the Date of Last Activity , reflecting my last payment correctly. I have a very recent bureau and I just went over it the other day and all of the credit reporting is bang on correct, should I still request documents? thanks Amanda
