Yikes... 14 year old debt... aged like fine wine...

That's probably past the statutes of limitations. :)

I would ignore them and do not speak to them any more. If you keep worry about something that is stats barred you will drive yourself to drink lol.

I have now received a Notice of Claim from ARO. It says the creditor is :GROUPE ARO INC - CANADIAN TIRE.

I don't know where to begin!!!! This is beyond the SOL but I also don't want to acknowledge the debt and re-start the clock. Anybody have a sample letter that I can send that says for them to sue me for it but at the same time make them aware that I know about the SOL and they can't get anywhere?

My goodness I would have so much fun with ARO on that one. :X

I know none of us really reads all the fine print in cardholder agreements, but does it say somewhere that our agreement to pay includes any company that purchases the debt from the original creditor?

ARO like purchased the debt and are now the first party creditors... they can charge whatever they like... since it's past Statutes of limitations.. they can't really collect on it.

Interest on old debt

Postby Terrishere » Thu Mar 18, 2010 02:10:51 PM

I am sure this is not really a new topic, but I have been searching posts and cannot find my answer.

If a credit card debt is sent to collections...in my case a $700 canadian tire card...last payment date 1996....LOL...I just today received a call from ARO saying I owe $3600.00...this sat on my credit report for years and has since been cleared off due to the time. I know the SOL is long past but at what point did the credit card likely stop incurring interest? Originally back in the day it was a different CA so I assume that ARO bought the debt. If so can they add interest at the rate of the cardholder's original agreement?

Thanks for your help.
