Short of physically restraining him so that he can't get to a court house there is nothing that you can do to prevent him from suing you. That being said he is not going to -- the debt is stat barred (assuming it has been six years since you last acknowledged it) so he isn't going to.

Just stop answering unknown numbers. Talking to them means they still have a hope which means they will keep calling.

I haven't got any paperwork dating back that far. If I had all that from way back then I wouldn't be in the heap of steamy poo I'm in now. I figured since it was paid off I had no worries and I haven't heard from anyone in regards to it since I called them last to confirm they had the final payment and nothing else was owing. Its been 7 years this month since I made that final confirmation call. I called the bank who gave me the loan, they said it was 'written off' and she had very few details about it. I called my old bank to get copies of the checks and they said that accounts closed for more than X number of years they have no archives on.

Initially when this jerk called he gave me no information, all he said was 'give me your date of birth and social insurance number' to which I refused and he immediately threatened law suit. Now I am not experienced with this kind of stuff so I didn't know what I should or should not do. I told him to tell me who he was and why he was calling and he refused until I gave him my personal data. I still did not. I will not every time he calls which apparently gets him very angry.

Tonight I told him that based on the research I've done, he must introduce himself, his company and the company he represents as well, he is not allowed to threated law suit (because it is apparently the federal portion of student loan?? correct me if I'm wrong?) Then I told him that I paid it off in 2002 and that even if I did owe at this point it would be stats barred and hung up on him. He hasn't called back tonight but he will. What else can I do? How can you be sure O.C. that he won't proceed with legal action?

You're a funny guy OC. Probably one of the only ones out there that wishes he had a collection agency calling him.

Damn I wish I had this guy ringing me up! Why do some people have all the luck???

Mate, you're passing up a prime opportunity to vent any pent-up frustrations that you've been carrying around over the years. If I were in your shoes, for starters, I'd have sent him a Cease and Desist letter which in it, would demand that he supply you with evidence demonstrating that you infact owe this debt. I'd also make sure that it clearly states that you dispute the debt in question and that you would like his firm to initiate legal proceedings at the start of the next business day!

If on the off chance that didn't put an end to the calls, well, I'd be tormenting the little telephone terrorist until the msg became loud and clear. See, that reject isn't going to take you to court. You've got to keep in mind, this person (and I use that term loosely) is at the very bottom of the financial industry. Heck, the imbecile probably can't even count, let alone comprehend any of the laws that govern the industry he's working in. Knowing that, I'd be having a field day with him if I was in your shoes. I'd be ringing him up all the time; just to shoot the breeze, to ask him questions about the things like his family history - whether or not his older brother and sister are planning on having any more kids together?!?! Anything to show that I was in control of the situation and that I'm not bothered by the fact that he's too damn lazy to dig up evidence which would validate his claim to there being an outstanding debt.

But that's me; and yes, I've dealt with my fair share of these Vultures over the past few years. The link to that limitations act that I supplied in my last msg contains quite a bit of information that you should try and ramp up on. Once you get into it it's actually a fairly easy read; so try and avoid discrediting your ability to comprehend the contents before you've given it the old college try. If you won't take charge of the situation, then you can expect this Vulture to keep picking at your ignorance until he wears you down.

Do you have a release letter that the loan was paid off or a receipt showing paid in full? Did you call the place where you got the loan and explain to them you’re getting calls for a loan that was paid in 2002? Is the debt showing in your credit file?

The guy keeps calling, I've explained to him that the loan was paid off in 2002 and that even if I DID owe the money, that it would be stats barred. He is upsetting my entire family every time he calls. I refuse to give him my personal information which angers him and he starts getting rude. Every time he threatens to sue me so I told him from the research that I did, he cannot threaten to sue me to which he made further rude comments. What happens if I don't answer the phone, can he sue me? I tried explaining this over and over that I have no reason to be getting these calls and that the loan was paid off. I don't trust these guys, if they sue me won't it look bad that I ignored them? Won't it look like I'm trying to hide something when I'm not? At the same time I can't deal with his attitude, what do I do?

Federal student loans have a six year SoL so if the last time you acknowledged the debt was in Feb 2003 then the debt is stat barred and they can't do anything to you.

I would ignore them. Don't communicate with them in writing or your might restart the clock.

I have no paperwork from this at all. Initially I never even got a statement from these guys, I just assumed that because I did owe for my student loan that he was being honest. It was so long ago and it was paid off so havingheard nothing in years, the paperwork has been destroyed or lost, whatever. It's gone.

It was for the Federal portion of my student loan. The thing is, at one point I actually did owe this money, i won't deny that. But I paid it off and apparently the funds I sent were never posted to my account. I asked CBV last night what they did with them, if they put them in a slush fund or used them for their company Christmas party and they guy said 'yeah, and it was a good party...blah blah blah' I called the bank I had originally taken the loan out with, they said it was written off (I guess meaning that it was sent to collections) and that they have no record of receiving payment from Concord.

What kind of student loan?

Private, provincial, or federal?

They all all treated differently.
