Just to let you know it could well be a stat barred debt and that is why they are refusing to give you any info. Interesting but the collections act states that if you havent received or if you claim not to have received something in writing then they must resend the letter to you and cease all collection activity until you have received it. I am sure that they fall under the collections act since they are acting as a third party in collecting the debt.
Again, if you can record every conversation because you have no idea how much trouble you can get these folk into. Also, it is important not to pay anything until you have the correct paperwork. If this debt is stat barred and then you make a payment you will be extending the legal timelimit.

If you are buying a home, has your mortgage broker found this item on your husbands credit. (i hope you got pre-approved)

Hi, Richard the reason I gave them banking info over the phone is because I'm an idiot! We have never received anything in writing from these people they keep saying its been sent or I've just emailed you the letter.. Which never happens...They had me so upset and flustered yesterday, saying crap about court etc.. I did the stupidest thing in the world I fell for a scam..we are in the process of trying to buy a house and I thought if I just got rid of them it would look better, but I'm a fool...its an old debt of my husbands before we met he doesnt even remember what year because they won't even tell us that!!! I paid an imaginary bill is what I did... but the bank has put stops on it and until we see paperwork they are getting nothing!!!

The reason you want to treat it as a law firm is because that then puts her under the scrutiny of the law society. The code of conduct for lawyers prohibits so much of what she does that if people were to actually bring enough complaints before the Benchers she'll get fined and either have to give up her license or pay.

lol probably true but not what I meant. She is acting as a collection agency with regards to how she is handling the debts and therefore will be limited with what she can do based on her clients instructions and clients rarely if ever tell agencies to sue now. Its due to the bottom line. How much does it cost to realize on a judgement. Do you end up spending more money on recovering that debt than the debt is worth. The courts sympathize with consumers especially if they are attempting to make payments based on what they can afford, regardless of the amount.

So Natale will say sue over and over but will do very little :)

Natale is a lawyer so technically it is a law firm. She just failed at life so now runs a collection agency.
