Thank you for all the feed back. I got them to settle for around 60 cents on the dollar and paid it. They agreed to send a release of any further amounts due, but it has been 3 weeks and nothing has come so far. I did get them to send a fax saying that if the amount of bla bla bla was paid by a certain date, which I did, they would send out a release of any further obligation to the debtl.. nothing yet so I am wondering how do I enforse it now

No need to worry. I'm sure George Krieser, owner, founding and animating spirit behind Total Credit Recovery will understand your son's illness and predicament. After all, look at all the hospital and fund raising boards which deal with illness that he's on.

If that weren't enough, one of his collectors, scolded me me right on this forum last month that they don't pursue sick or disabled people over debts. And if you can't believe a collector, who can you believe?

To answer your first question, debtors jail is a history so no matter how much your son he won't go to jail for it. All they can do is to get a judgement against him. With 20k they have to go through a civil court in order to obtain a judgement, however the process is long and cost ineffective for your son's situation.

If you aren't a co-signer, you have no legal obligation at all to cover his debt. Furthermore, I highly doubt the person you spoke to is from the bank. Bank representatives will not be rude and mislead you because of PR issue. There's a very good chance the person you spoke to is from a collection agency. Those collection agencies always give us false info and mislead you to think that you'll pay for your son's debt. Don't pay them a dime and tell him/her to leave you alone or you'll file a police report for harrassment. Even if you're covering up for him, so what? There's no law saying you can't cover up for his whereabout.

Help, please, I am so distraught about my son's debt. He was doing so well, but was diagnosed as Bi-Polar last year and everything went crazy. He refuses to take medication and his life turned upside down. He had such good credit before that the bank had given him a 20K loan(which he was doing fine with until the winter) NOw the bank has sent letter of arrears and today I recieved a rude call from them. He no longer lives with us and I hardly ever see him, so I told the young man that "no, he doesn't stay with us anymore" and he rudley commented that his MOM would not have put it that way and said he thought I was covering up for my son's whereabouts. In a way I was because I know he has a cell phone and can't afford the minutes on it as it is and he is barley making enough money to pay rent with his 2 friends.

My first question is this: Will the bank "SUE" my son for the money and could he go to jail?(I have suggested bankruptcy but his state of mind will not hear of it)
my second question is: do I have rights as to how I was treated by the bank's personel that was rude to me. I have no legal or financial obligation towards my 23 year old and told him that but he insisted I was covering up for him. There is no co-signer on the loan either.

My first question is the most important becuase they did state in a letter that legal action would be taken to get this debt paid.
