I think you nailed it...the message itself is designed to intimidate one to act. And you know what, in all fairness, it is pretty cleverly worded.

Look at the buzz words..."lawyers", "final call","superior court", "cost of your judgment", "assets", "legal action", "out of court settlement".

I think the message itself gets lost and one may only here those words.

Oh my last lifeline. What am I to do?

Thought I would throw it up there for all to peruse (or mock) depending on your inclination.

I'm not quite sure, but, if you were going to be sued, wouldn't you just be served? Why all the threats over going to court? Just serve me already.

I hope people wake up and start ignoring these ridiculious messages. The only reason they leave these messages, so they can get people to settle fast before the file goes back to the creditor.

Yes, this is a run-on sentence.

No the person didn't take a breath during the entire message.

Obviously PIPEDA means nothing as this was left on an unsecure / public voicemail. Alas, according to PIPEDA precedent, the most I could expect is an apology. Hey, wait a minute?!?

"Hi, this message is for X - X I’m calling on behalf of Y regarding this ah $Z credit card name the lawyers have asked us to give you this final call they are ready to file claim in the Ontario Superior court against you for this unpaid debt once it goes to the lawyers of course they charge $A and that will be added to the cost of your judgment and once judgment is brought against you X they go after your assets now before they take any legal action against you of course they are asking us to call you and are prepared to offer you an out of court settlement but you need to call the number I am going to give you once it goes to the lawyers they do not negotiate with you I’ll give you a number to contact to take advantage of this phone call…"
