It was not a joint bankruptcy and it was included. My spouse is only an authorized user. They have acknowledged the bankruptcy(Capital One),but refuse to give us the agreement that he supposedly signed. He did not sign anything.My trustee told me the interest and everything must stop when the card is bankrupt,but they keep adding fees and other stuff(in my husband's name now only the bill). Trustee also said to ignore this,but it scares me. Thank you for your reply that was kind.Job loss required me to file and tomorrow my husband will loose his job too. Thanks again.

When you declared bankruptcy in March this year, was it a joint bankruptcy? Was the Capital One credit card included? If so, I suggest that you provide Capital One a copy of the discharge paper you received from your bankruptcy Trustee.

If the balance was not included in bankruptcy (but I can not imagine why this will be left out), then I suggest you go back to your Trustee and find out the best option to deal with this issue.

Hope someone can help me with this.I had to declare bankruptcy in March this year(2009), My husband was a authorized user on my Capital One card. When I filed the balance was 7300.00, now 6 months later it is 8300.00 with interest up to 26 percent. I have asked 6 times for the contract he signed and am being ignored. He never signed. When I called 3 years ago and asked them to remove his name from the card they said no with no explanation? It has now gone to collection and today received a letter act now or risk legal action. I have now written capital one and asked to be only contacted by phone as the calls are every day.I read about the debt validation procedure and will send that off. What happens if they take us to court? Or will they, my husband will loose his job tomorrow ,and I am not working right now.He has no assets we rent, and the car is in my name. I am getting nervous by the day, I want them to send us the copy he signed, this was opened in 2002. Any help would greatly be appreciated. Thanks
