Hi everyone. I declared personal bankruptcy in Sept 2008 after responding to an ad in the paper by my trustee. In July 2008 new legislation was passed changing the amount of time before student loans could be discharged following bankruptcy from 10 to 7 years. I had really good credit when I declared bankruptcy, but I could not get out from under the weight of these loans (min payments were $500 monthly). So at the advice of my trustee I decided to declare bankrupcy on the loans, as I had been out of school for 7 years at the time. 2 of my 3 loans (which were bank loans) were cleared with the bankrupcy. However, my National Student Loan was not. I called them and was told I still have to pay it. I explained the nature of the bankrupcy and asked them to explain why they feel i need to pay this seeing as the law states very clearly that the loan should have been discharged. They were very abrasive and told me that they refused to give me any information, and that I was still expected to pay the loan. They told me I need to talk to my trustee. I have tried now for almost a week to contact my trustee, but for one reason or another he is not returning my calls. I am very unsettled by this. He has always told me though that I would not owe this money. I have searched all over and cant find any indication that I owe this money. What is going on? Am I being bullied? If so what can I do about this?
Thanks for any input.
