The statute of limitation goes by the last time you made the payment on the account or in your case when the first payment was supposed to be made. If you write them a letter acknowledging the debt that could reset the sol, if the statute of limitation has not passed. If you write the letter like you stated listed below, that should not reset the sol.

I give permission for you to contact my husband, or for him to contact you about my ALLEGED debt. My husband's home telephone number is xxx.

One last question, if the debt was in my spouse's name and she wanted me to contact them - I assume there would have to be some sort of written permission. So if we phrased the letter along the lines of ...

Do you think this would impact calculation of SOL?

I know this is an awkward question b/c the debt is my wife's and she intends to pay at some point - but we need to know the ramifications of the letter because she wants me to deal with them, rather then herself.

The tears today after they called her at work said it all.

My initial response would be to ask them very politely not call her at work again, otherwise we have all communication going through our lawyer. Not sure if they would respond / respect that wish but then what we would do is forward it along to our lawyer.

Stupid thing is the amount is <$5k and she is wigged out by their threats of (and I quote), "legal department, sued, claim statement, pay it today, legal fees, wage garnishment, no claim yet if you pay"

Unfortunately I'm a bit more seasoned, but that doesn't help me one bit in her eyes.

The creditor likes to make attempts to settle the matter before it sends it off to collections.

Good to know.

Interesting also that it stayed with the original creditor for nine months after that missed date.

It would go by the first time you were supposed to make the first payment or the following month when you miss your first payment.

Just curious if anyone knows how date of last activity is calculated on one of those don't pay a cent type plans?

Lets say I made a purchase in Jul 07 and deferred payment until the end of June 08 (since they offered).

Now lets say I did make the odd purchase within those 12 months and paid off those purchases on the same card - but when it came to pay for the deferred purchase - I never paid a cent.

For the sake of reporting, how is the DLA calculated for SoL consideration?
