It is more important to get your health in order and you sound like you on the right track. I would tell them go ahead and take you to court And then you go into court and explain about your health and about how your trying to get better And by the time the court date rolls around if it even does you also will have a doctor note and then lets see them look stupid

Baileyboo,

1) They cannot refuse a payment. even if it is only $25 or whatever, they cant refuse it. Careful how they word it, when you offer the $25, they likely never say no, but put pressure on a larger payment

2) If you have no income/assets, and they threaten to take you to court, let them. The court will review your income, assets, debt, etc and will find a suitable judgement.

This happened with a friend of mine, he was out of work for 18 months, but couldnt apply for employment insurance or any sort of assistance, he had to move in with him grandparents. Some debt with Rogers was forwarded to a collection agency and when they told him they were going to take him to court, he didnt back down. They ended up taking him to court (it was a much larger amount than you owe) and court ruled the debt dead. He still had it on his credit report, but they couldnt pursue it.

I think there was more to the story, but basically what I am saying is, if you have no income and assets, dont be afraid of the court threat. If youre not working, then you have the time to go to a court hearing, and the judge will see the collection agency is at fault for pressuring you so far.

We can't tell what a collection agency is going to do... we are only guessing.

You'll just have to wait this one out...

They aren't going to sue you, they threaten everyone with that. You seem to already know the answer since you're listing that you have no assets/income. They will just keep threatening legal because they can't really do anything.

Hi. So here is my situation. About a 1.5 years ago I had a stupid idea and got 2 cell phones on contracts. Do to a very high level of stress I stopped working, and cancelled the contract. I now owe a little over $1500.00 to the cell phone company. In Febuary 2008 they sold the debt to Nordon collections. After dealing with them for about a year, they decided to sell it to D & A Collections. ( It has now been passed around to about 3 - 4 different collection agencies) Now I am getting calls from them asking me to pay the $1500.00. I said that I dont have the money, but could make very low payments, from odd jobs that I do here and there, but they want a large payment first. I personaly am living with family, and do odd jobs here and there... maybe get about $20.00 a month. They allow me to stay in there home as long as I do some work around the house for them for free. I dont plan on working for about a another couple of years. I am now looking into conselling and going to try to work on feeling better mentaly before even thinking about getting a job. So here are my questions: Do you think that a collection agency will take me to court for the $1500.00 I have no assets, and no income. Plus it has been in collections for over a year. If they were going to take me to court, would they have already done so? Thanks for reading I now this is very long!
