I can see that you were addressing Saskatchewan in your response to this question - and I have not reviewed that provinces collection laws.

Just wanted to point out for others that according to Consumer Protection, this is not the case in Ontario.

Per: http://www.gov.on.ca/mgs/en/ConsProt/STEL02_045978.html

The regulations forbid collection agencies from:

Contacting you until six days have passed from sending you written notice of the following:

• the name of the creditor

• the balance owing

• the name of the agency and its authority to demand payment

That link also outlines other prohibited collection practices, too.

collection agencies don't have to send you a letter.
They usually send those out as a tool to remindyou that you owe money.

Make sure that you check with Saskatchewan Consumer Protection to ensure that both the collection agency, AND the collection agent is licensed in that province.

one more question, do Collection ageny have to send you (me) a letter,saying my account has been handed over to them
or as this Shawn said by law they don't have too.
Shawn is the person from the collection ageny.

Really thats good to know!! So if he he say's that he will take me too court again, should I ask him if he has one and take it from there?

If your in ontario should have asked for his license i bet he dosent have one you can get it paid free. Most collectors in the states do not have ontario licenses.

So if they phone just wait it out and see what happen's and hope that the checks get their by Tuesday, now can they send them back to me, and if so what do i do?

Doesn't sound to me like you have anything to fear. That trash-bag was simply blowing hot air. He's from a 3rd party collection firm, and probably quite pissed that the chq's weren't mailed directly to his office - as now he can't claim any commission from your payments.

So if Mr. Trash-bag opts to give you another ring, you may choose to recommend that he find a nice tall tower, climb up it and take a good leap. What do you care? You've mailed in your payments; so if they arrive on Friday or next Tuesday, the problem will be resolved.
