Yes they can launch a lawsuit to mitigate their losses – every creditor has that legal remedy available to them. You signed a contract after all. But the bill collector bark is often worse then their bite. Lawsuits are rare and they are usually (but not always) launched from a business perspective. What that means is, if they spend money to sue you, what are the chances they are going to recover it if they are successful in court.
At the end of the day, becasue the remedy is available to them, everyone should expect to get threatened with a lawsuit when they are in default or in collections. Its one of the disclosures we make to all of our clients in our debt settlement program

And no, I don’t think you will have a criminal record if you are ever sued for debt, unless the creditor can prove some level of premeditated criminal fraudulence, which I have never seen them do. I think they would have to prove to the courts that you actually woke up in the morning and said to yourself "Right! I am going to rip off some creditors today"!!! lol
If you don’t have the money to pay, there isn’t much they can do but tick you off… if you let them get to you.
Do what you are doing and read posts on here, there is some good advice, but take it with a grain of salt.
I am not advocating hiding from your debt or not paying back your obligation, everyone should resovle their debts, but if you are not able to for the moment sit tight and, as Joe pointed out, do it on your terms and try to settle when you have the money available to do so. Good credit matters but not as much as your own survival.
