The Ontario act will apply, because the contact was signed in that province.

NWT is tougher - but its still a privacy issue - try calling the Office of the Privacy Commissioner's Investigation Branch @ 800 282 1376

Actually I am not in Alberta. I am in Northwest Territories (no option in the accoutn set up here for NWT) and from what I have been able to find, our Consumer Act is very lax on rules with debtors, a total of 6 paragraphs about it, and none of them specify contact at work.

However, the agency is in Ontario and the debt was created in Ontario, does the Ontario Act apply or does NTW since it is my present location?

You have 2 major issues here. The issue of work contact is one issue; the other, and more severe, is disclosing the existence of a debt to your coworkers.

If you are in Alberta, this collection breach can be addressed with this on-line form: http://www.servicealberta.gov.ab.ca/1006.cfm

Your privacy issue can be raised here as well: http://www.oipc.ab.ca/pages/home/default.aspx - You will need to call them about the complaint process.

Bottom line the message you got, totally uncalled for. Your province is tough on collection agencies.

Keep your proof you will need it. This should also offer some bargaining power with the original creditor, I would try to deal with them directly and bring up these unethical collection practices, and provide proof of your complaint, then talk settlement.

I believe they are allowed to call your work once to find out where you live or for your telephone number. If you give them your home telephone number and state to them you wished not to be contacted at work and they keep calling you at work, I believe they are at breach. I would look up the collection agencies laws in your province or they might be on this site under the faq section.

Need some advise.

I am in the process of trying to settle with a debt held at Active Capital. They are not accepting the offers I have presented and this morning they actually called me at my office.

I was on the phone and do not have voice mail, messages are transferred to me by my office admin. The message I received through her was "Please contact *** @ Active Capital reagrding a large outstanding debt that needs to be settled."

Is that not breaching my rights in regards to contacting me at my office?
