I dont think you have a judgement againest you as I got a letter that was faxed to my boss and it looks like a Judgement however when I started digging in to the small claims files they had no listing of a court dater with a Judgement againest me so it might be the collection agency using scare methods on you I called the collection agency and no one claims to be able to tell me anything other then I am getting my wage garrish while so far no garrishment has appeared on my pay and the debt is stats banned in 2010 And I am still trying to get this stupid debt off my credit report so far all Equifax and Trans Union have told me is they got my forms telling them I disagree with the debt and are looking into it

Are you sure the collection agency has a judgement against you? Did you go to court? Did you get papers to go to court? Did you get an offical court copy of the judgement? If not, there is no judgement.

If there is a judgement and you either went to court and lost or ignored it, you might as well take the 15% off since that's likely the best you will get. If there is a judgment, but you were never notified of the proceeding you can go to court to have it set aside.

If there is no judgement, how long ago did you make your last payment? What province do you live in? A letter signed by a collection agent purporting to be "from the legal department" with a non existent judgement against you is dynomite... and you're holding the power to light the fuse.

Personally, I suspect there is no judgement.

The collection agency has the judgement against me, so I assume they purchased the debt.

I have not rec'd the original copy yet. All I have right now is a scanned copy that was emailed to me.

hey jimmy,

Is the collection agency able to settle on behalf of the creditor?
Is the letter signed in ink? I think this should be a standard form that's registered with consumer protection... to see if it's legit.

Can I get a copy of that letter to show people on this forum?

I have been dealing with a collection agency to settle an account I have outstanding. They settled on an amount (a reduction of approx 15% (more if you factor in the interest that had accrued since the judgement against me))

The letter is on company letterhead signed by the collection agent in the legal dept.

Is there anything I should be looking for to ensure this settlement is legit?
