Just tell the bureaus that there is absolutely no creditor that you owe this or any other money to. Also state that CBV refuses to disclose any particulars about the debt to you. This is contrary to law since they must reveal in writing to you who their principal is and what the particular delinquent account is.

Then, either the creditor or the collection agency acting for them has to supply the credit bureau with documentation to prove the debt is outstanding and delinquent or the derogatory item must be removed. That's the law.

Hey Raymond

Thanx for the responses. No I dont know for sure who it is for and CBV will not give me any documentation regarding any acct, They have stated that as the debtor I am not entitled to any details or documentation. I discovered that CBV was on my credit report while in my bank today and all that was stated on Equifax was CBV collections, nothing more. You stated in your post that there is a 6 year time limit for a negative on your report however, all that CBV will tell me is this is for an acct that was closed in 2005, the only account I can recall closing at that time was a Telus Mobility account, so I contacted them and they said the account is at $0 and that is all they can tell me, therefore I don't believe it is for Telus Mobility and at this point, like I said, I am not even convinced it is me they are after. So if it is from an account that was closed in 2005, and I have recieved absolutely no notice about any delinquent account, can they now decide, 3 yrs later, to post it to my Equifax file in April 2008? You mentioned to contact TransUnion and Equifax with supporting documentation, since I don't even know who the original debt is supposedly owed to I have no supporting documentation?? Any idea what I can do?

Thanks for any help you have and can give me!!

Well, gosh, who do your credit reports say you owe the money to? Yes, Alberta has had a 2 year limitation period for litigation purposes since March 1, 1999, but negative items still stay on your credit report for 6 years from the date of last payment to the original creditor.

If you disagree with the items on your 2 credit reports, send in a dispute with any available supporting documentation to TransUnion and Equifax.
The creditor will have back up the delinquent posting with documentation or the credit bureaus will have to remove it from your credit reports.

You're supposed to owe someone 1800 bucks and you have no idea who?

CBV Collections contacted me a while ago claiming that I owe over $1800 for a debt from 2005. They refused to send me any information regarding the debt, literally telling me I don't deserve it. I told them I disputed this debt and to take me to court. They have since called me numerous times, every time behaving extremely abusivly. Then today I found out that they have added the collection to my Equifax file, with no explanation accompanying it.

The first thing I'm wondering is if I am disputing it, can they just arbitrarily add it to my Equifax file, and what can I do about it? Secondly, I read somewhere on this site about a Statute of Limitaions being 2 years, and unless I have acknowleged the debt they cannot come after me for it, is this true? I am still trying to figure out if the debt is truly mine, as I was working out of the country for 2005/2006 and had someone else paying my Canadian bills, and since I have not been contacted sooner, I am having a hard time believing it is mine. However since CBV will not even tell me who the debt originated with my hands are tied.

Any advice?

Your story doesn't make any sense. Methinks you are leaving some details out.

CBV and Credit Report

Postby pibit1130 » Tue Jul 08, 2008 03:26:26 PM

Hello Folks and thank you in advance

I have started recieving some rather abusive phone calls from various agents from CBV collections beginning in april 2008 saying that I owe money on an account. These people have been saying to me that I have to send them the balance of this account ($1800.00) of which I have refused because they will not send me any details of said acct. All they have told me is this is from an account in 2005 and CBV has recieved it in april 2008. I have repeatedly told them that I will not just pay some money because some faceless voice tells me I owe some money. Consequently I just checked my credit report and lo and behold if CBV collections is showing on my credit report. I have told them over the many phone calls that I dispute this and will not consider anything till I see the details of this account of which they refuse and tell my that as a debtor I am not entitled to it.

Can someone help me out and let me know what I should do to get this off of my credit report? And is there any recourse I have ie. BBB or any other organisation that I can lodge any complaints with, also am I allowed to record these phone calls as they are rude and nasty and I cannot believe that they can carry on business like this.

Again, thank you for any and all advice
