Hi,
I am so glad to have stumbled on this site while doing a google search on "Pomer & Boccia.....I have read through many threads and will admit am a newbie to forums.
I was hoping anyone could offer advice/suggestions to my scenario....

Upon the advice of my lawyer (several years ago) after my split with my ex and I was stuck with loans and credit cards in MY name for HIS use....(dummy!!..I know..haha!!)....I was told to ride out collection efforts for 6 years and it would all 'dissapear'....

I actually haven't gotten any calls, the odd letter here and there which I ignored....until now. Time is running out for Pomer & Boccia and they have until July 2008 to collect (on the very last account). They have called and hounded relatives who I haven't seen for 15 years, even calling their childrens phone...asking personal questions totally irrelivant to finding ME....like, so who are you married to and how long....blah blah blah....they are told that it's none of their business, but they still ask stupid questions....
They even continue to call several times of the day, despite being told they did not have the right number. I feel terrible that they are getting harrased...but they still won't give them my phone number...
Well, now they have started phoning my 68 year old mother (who co-signed for me) and harassing her. She told them they had the wrong number and not to call again...but they called right back and left a message on the answering machine telling her that YES, they do have the right number.
I have pulled my credit reports from both TransUnion and Equifax and I have a perfect record. None of these old loans are on there (or on my moms report either, as I had her pull hers as well). Gone. I looked at one report that I pulled a couple of years ago, and they are on there, and the DLA is 2000-06 on one and 2002-07 on the other.

Ironically, they were sending my mom threatening letters on the one that had the DLA of 2000-06.....has the time not passed that they can't call to collect on that one??? Just over 8 years.....
And I assume that the other one with the DLA of 2002-07 only has another week left?? This was the account they were asking my other relatives about....
I mentioned to my lawyer that I should just pay it now (about $3K) so they leave my family and more importantly my mother alone (she is recovering from breast cancer and doesn't need the hassle - note: she kicked its butt!)...anyway...he said not to do a thing. What can I do to get these people from calling my family???? The time has passed, hasn't it?

Any advice/info would be greatly appreciated!! :o)

Plainly, it's a fake legal notice stating if you don't pay within a guideline, they will sue you -- unless you live in PEI, NB, NS, SK & maybe NL (not sure).

Acknowledgment would consist of making a payment or a written letter with your signature.

They cannot sue you. They MAY send you a drafted "statement of claim" ala Deanna Natalie, but they can't sue you. They can however call you to demand payment, however.

Hello,

I have searched up and down and have only found mixed answers so I thought I would post for clarity. I am living in Tel Aviv now and wish to move back to Canada where I was a student to marry a Canadian I met. We want to make sure everything is set before the wedding so I pulled my credit report.

Did I reinstate the SOL by calling the collection agency after I have seen them on my Credit report for an unsecured Alberta debt from 2002?

Also is there anything I can say on the phone to reinstate it? Or does everything have to be in writing to be considered an acknowledgment of debt?

Now they are calling my finance and stating that I have limited time to contact them to make arrangements or they will proceed with litigation against me. Are they just trying to scare us? If they have not received anything since 2002 (going by date of last activity on credit report for that item) can they still sue? We are going to be living in Toronto so will it be the Alberta laws (where I went to school and got incurred the debt) or the province which I will reside in at the time they choose to sue?
