Hello and thanks to all the replies.

Yes the debt has been paid in full 2.5 years ago and the mother in-law will confirm that. but she said she does not want to deal with what he the father in-law did even though he had nothing to do with the money being loaned to my wife and I.heck I did not even know he did this untill he had passed away.

so I guess I will go and see about putting a judgement on her untill she removes it. I think my other oppion would work faster seeing that she is trying to sell her house I could always go and put a lean on it for the reno's I did.

either way I just want it off my name

what about going to the court house where it was filed and fighting it and letting them know that the father in-law will not contest it seeing he has passed away.

keep the replies coming as I dont know what else to do

thanks again.

Your mother in law may be the executor, but she is not your only avenue. Do you have any evidence showing you've paid the debt? If so, you can send it to the credit bureau. You may also be able to approach the lawyer handling the escrow of the estate, if it is still in escrow.

You may be able to point out to the mother in law that knowingly allowing false information to be on the bureau is defamation and you can sue her for that. You may also be able to apply to the courts for a judgement requiring her to remove the listing.

This is all assuming the debt is really paid. Your father in law's death would not likely relieve you of the requirement to pay the debt. In all likelihood, especially in the case of a court judgement, you would owe the debt to the estate.

I think it requires your in-law to get a lawyer to deal with it.

how to get a judgement off my cedit

Postby helpneeded » Sat Mar 08, 2008 06:35:59 PM

can someone please help me I have been dealing with this way to long and I have no answers this far.

what I am asking is this

I have a judgement on my credit that my father in-law put and never told me about. yes I did owe some money but I did pay if off and my mother in-law knows. now what my problem is this that when I found out that the judgement was on my credit my father in-law died 2.5yr ago so now I am told that this thing will be with me forever. my mother inlaw was the Executive of his will when he died and said she does not want to deal with what he did so how do I go about getting it taken care of ??

I thought about giving her 2 weeks for her to do a letter stating that it was paid in full and outright or I would march right down to the court house and put a lean on her house for the $10000.00 on the work I did to her house just to save her money in return but that's not me

so can someone give me good solid canadian legal info on how I deal with this judgement please

thanks
