In your first email yesterday, you said

"I am VERY SCARED AND DONT KNOW WHAT TO DO IM A SINGLE MOM AND ONLY EARN MIN WAGE WORKING AT MY JOB FROM HOME .Please someone help me."

Now, you mention you've already got a lawyer to advise you.....Guess I'll never learn.

Well, sounds like someone else is going to be in legal trouble. Again, you're short on details, but maybe a call to the police is in order if funds in trust were withheld. Or perhaps a call to consumer lawyer, Mark Silverthorn, who's close by you. He states he gives free consultations, but I'm sure it's just to qualify callers.

Yep, you're right, I was careless. I saw the same 2 pages as you ie.

http://www.bankruptcy-canada.ca/alternatives-to-bankruptcy/orderly-payment-of-debts.htm

http://www.bankruptcy-canada.ca/consumer-proposals/what-is-a-consumer-proposal.htm

for OPD's and CP's respectively, but I was on the fly for an appointment when I answered "Homework" this morning.

Nevertheless, the points I was interested in, were (1) why she's still receiving threatening collection calls from Kupferstein if there's been some sort of agreement that she's lived up to; and (2) of even more concern and cause for caution would be if she had, in fact, obtained a loan or credit through fraudulent statements. If Kupferstein learned that she had, then he might well be using those threats as collection leverage.

I have no way of knowing what happened as she only seemed capable of channelling her energy into "freaking out," instead of disclosing details.

@DanielBl

Orderly Payment of Debts ( OPD ) is a debt payment alternative to Bankruptcy and is offered under the Bankruptcy and Insolvensy Act.

OPD is available only in Alberta, Saskatchewan, Prince Edward Island and Nova Scotia. This program is also known as a "consolidation order".

OPD is similiar to Consumer Proposals but is considered to be a less drastic solution. It extends the time ( up to three years ) to pay off your debts and is legally binding on the creditors. However, it differs from Consumer Proposals in that you cannot freeze the interest or negotiate a reduction in the principal.

"Homework" apparently lives in Kitchener, Ontario and therefore, does not qualify for the OPD program.

We can't go any further unless you supply that info. It should also be noted that if you're under a registered orderly payment of debt (OPD), the collection calls are supposed to stop. How much you owe would have been determined at the outset and documentation of the anount(s) would be contained in the agreement. What's going on here? Did you miss your payments?

I have asked for written information about how much I owe and they told me that they can not give me that information.I am now pursing help thru a debt consolidation company here in kitchener to get all my debts taken care of.

Well, yes, you are the kind of person collection agencies go after. Nothing personal, you understand....Survival of the fittest...Financial Aryanism......Darwin.... The weak and vulnerable must be eliminated.... Only the financial strongest have the right to survive... The wolves only go after the weak to purify the herd....etc, etc...blah....blah.

But enough of financial metaphysics..........You still need to describe the circumstances of the debt. Did you obtain credit by fraud? When was the last payment or (signed) written acknowledgment date? How much do you actually owe?
