I did speak to lawyers and paralegals. They agree that although TD is totally wrong on this, and has screwed up on more than one occasion - I would never be able to fight their team of lawyers.

Like I said - I'm burnt out from this - been working 3 jobs and raising 3 kids in the process, negotiating debt settlement, recently separated - I've got no fight left - however I will get some sort of satisfaction by telling my story. I want people to know how heavy handed and ruthless the TD Bank is, not to mention how clueless and imcompetent their staff is.

I want to make sure that people are aware that the banks are not held accountable for their mistakes by the Ombudsman or the government and they know it. They simply don't care what the cost is to the client. However I'm sure if we were at fault - the banks would hold us accountable and then some.

No... I mean... you want to file a lawsuit... you can't afford a lawyer... is there any reason you can't file the lawsuit yourself and represent yourself? Perhaps you can hire a lawyer or paralegal on a consulting basis and do the majority of the work, including representation, yourself..?

I've tried - they've been harrassing me for almost 6 years now - they totally ignore my letters to them, but keep sending their lawyers after me and bill me for it. I've got their breech in writting - lawyers have looked at my file and said I have a very valid case - but too costly to fight.

I had borrowed approx $535,000.00 from them over the years for business- paid it all back but $14,000. I had never defaulted in any way ever. We closed the business - because TD said that the original loan officer made a mistake and shouldn't have financed me in the first place - so they called in our loans.

I've been to the Ombudsman multiple times (what a joke that is), my MP's office - with no avail. I had asked them for reduced payments on the $14,000 until the property sold - they sent my file to their lawyers - who gave me reduced payments - but then added on $9000.00 in legal fees. When this property sells - they will just take their share, because it is security for the loan.

I'm really burnt out from dealing with them - I've got the details of my horror story written up - I just need someone to publish it.

Why not do it yourself? You need to be ballsy to take on their entire team of lawyers, but you actually don't HAVE to have your own lawyer.

A good book, if you're considering it, is "Klar on Tort". He's a professor of law here in Edmonton and is recognized as an authority on tort law. It will give you a good basic.

I know our courthouse has precedents you can pay to borrow (keep the receipts, they're recoverable) and use the book, your facts, and their precedents to handle it yourself.

And then... if they drag it out... it costs them more money than it does you.

TD - breeched contract.

TD Bank made several errors on my business loan - costing me tens of thousands of dollars. I've got documented proof - but cannot afford to fight their team of lawyers.

Is there a venue to expose them, at least get them some bad publicity in order to deter some people from financing with them.

Also - am I allowed to mention names etc if I manage to find someone to publish my story??

With an article highlighted "TD Canada Trust is the worst bank ever", Canadian banks seem to be faced with the ever increasingly demand for good customer service. Unfortunately, it just doesn't seem to happening.

My favorite quote from this article is:
"The banking industry as a whole in this country is fundamentally more concerned about loss or the possibility of losses versus customer service and the general risk of doing business. TD is particularly bad in other ways."

I couldn't have said it better myself!
